About 6 months after my husband and I started dating, I was diagnosed with uterine cancer. At the time, I had no insurance, and so the medical bills racked up. Most of them were written off due to charity and financial aid. However, there are still smaller medical facilities hounding me for their cut of the cheese.

I have been cancer free for over 2 years now.

Anyway, my question is, if I file medical bankruptcy to extinguish my remaining medical bills, will that effect my husband's chances of getting approved at his AOS interview because of financial reasons?

We had my aunt who is a registered nurse, fill out a seperate Affidavit as a joint sponsor. Our annual incomes combined equal about $89,000.

I just don't want to do anything to jeapordize my future with my husband.

Also, what happens if you are denied at your AOS interview? :unsure:

September 18th 2007 - 1 year EAD card arrived

They don't look at debts (as far as I know) or credit rating at the interview, just what you submit on your I-864 (income and assets if applicable). You should be fine.

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Time to look at the I-864 and its' instructions, and see what information a Sponsor needs to provide for the adjustment of status.

The financial resources of a Sponsor and a Joint Sponsor do not get combined. If a Joint Sponsor is required their own financial resources must meet the requirement.

Ok, so she has to meet the income requirements on her own without my income?

That hopefully won't be a problem. Her income was $72,000. Mine was only 16,000 that's why I needed her.

Could they still reject us because I don't meet the income requirements by myself?
