I am a Canadian and my husband is a U.S. Citizen. We were married on June 16th and are waiting for our marriage certificate from the state of Washington before he can submit the I-130. I heard that once the immigration process is started that I will be unable to enter the U.S. until the visa is approved, today I was talking to a customer service rep at USCIS and she told me that being from Canada I can visit as often as I want until the visa is approved and I can move to the U.S. I sure hope this is true, I only leave 5 minutes from the U.S. border! Has any one else had this situation?

It is totally legal for you to visit, but it is up to the border guard whether he/she will let you in. You need to show that you have no intent of completing the immigration process while in the US (that is what the k3 is for). To prove that, you have to show ties to Canada (ie. employment, house, etc). I visited three times after we got married, but now I don't have any proof of ties (left my job, sold my house) so I have to wait for the actual visa, as I am not willing to take the risk being denied entry.

If you look in the Canada forum, there are other's who have gone back and forth during the process.

08/11/08 Infopass appointment to request 10yr greencard instead of conditional. Mailed out 1-90 with support.

09/25/08 Received case # for I-90

02/17/09 Received 10yr greencard!!! WOOHOO

Hi I'm currently in the states and i'm still waiting for an interview date. As long as you have a job letter. House. utility bills, phone bills, cable bills, apartment lease, I even showed them my T$ slip and my most resent tax retruns. You should be fine. Like the Other person said you just have to prove that you have ties and will return. Good luck
