Didn't submit I-693 medical with I-485 form, but my visa interview medical is still valid... Do I need to get another medical? (merged topics)

After 2 long years of waiting I finally have my Green Card interview scheduled for the beginning of March.

 

If I'm reading the instructions correctly, I don't need to pay for another medical because I had my K1 medical in December 2018 and submitted my AOS papers in March 2019, but it says something about needing up to date vaccinations.

 

IIRC, my UK doctor gave me everything they were allowed to give me in the UK, but said I might have to pay later to get some random ones that they only give here in the USA. How can I check what I have had and what I still need?

Did you get all your vaccinations signed off at the K1 medical? Do you remember whether they made you see the nurse for any shots or if they told you you were up to date based on the records you brought them? It doesn't matter what your personal doctor in the UK said, only what the doctor authorized by the Embassy put on your form at the time the visa was issued.

 

If they signed off on you having had all the appropriate vaccinations and you filed AOS within the timeframe (as it appears you did), you shouldn't need a new medical unless they lost your medical report which has, unfortunately, happened to quite a few folks. You'll be told if this is the case at your interview and they won't be able to make a decision until you get a new medical done here and sent to them. Be aware that you have to go to an authorized Civil Surgeon for any new vaccinations to be certified or a medical examination to 'count' for USCIS, rather than going through your own doctor.

I wouldn’t do anything medical unless you are told at the AOS interview that your shots were incomplete or your medical report was not found. Then you spend the money when you know exactly what they want, if anything. You get what is needed from a Civil Surgeon and send it directly back to your interview person. You won’t be in a long queue...maybe a week after he gets what he needs to approve.

Thanks both, very useful info! So in the event that *not* having my vaccinations at the time of my interview doesn't equal automatic deportation and death by firing squad (!!) then I think you're quite right in saying I'd be best off just going to the interview and worrying about any outstanding vaccinations based on what they tell me, if it'll only delay things by a few weeks. Hey I've been waiting since Feb 2019, what's a few more weeks now?! Thanks again.

I paid for a medical exam in Jan 2019 before I moved to the USA and submitted my AOS forms in March 2019, but I don't think I submitted my I-693 medical form with the I-485 form. 

 

I was under the impression that medical I had would be valid for 2 years, but I got a letter today saying I'd still need to complete and submit the I-693 form for my green card interview which has been scheduled for next month, March 2021.

 

It looks like the I-693 form has big sections that need to be filled in by a civil surgeon, so how could the medical I had for my visa still be valid if they also require this I-693 form to be filled in by a civil surgeon? Or am I missing something here?

Your medical from January 2019 is only valid for year. We're in February 2021 and your AOS interview is in March 3021, that's why they are asking for an I-693.

I don’t think it’s that.... At no point in my visa medical was it an option for my doctor to fill in an i-693 form so I don’t know where this idea that your medical would still be ‘valid’ if you had it less than one year ago fits in... because I’d still need a civil surgeon to fill in the form for me, right?

You do not need I-693. The K-1 visa doctor already filled out DS-2053, DS-2054, DS-3024, DS-3030, DS-3025, and DS-3026. Those forms should be in the A-file.

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

  • The medical examination did not reveal a Class A medical condition; or 

  • The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27] 

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28] 

 

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

 

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

Thanks, that's what I thought, but the letter I got through from USCIS today said "Form I-693, 'Report Of Medical Examination And Vaccination Record', must be submitted for each applicant", and didn't mention anything about who might *not* need it.

The I-693 form instructions say I don't need another medical but I do still need to fill out Parts 1. - 5., 7., and 10. of Form I-693, so I guess I'll just do that?

No. I agree with @Wuozopo's post above to go to interview first and then only do I-693 if the IO says so. Odds are you don't need I-693 at all:

Are you referring to the interview letter or the I-693 courtesy (aka deficiency) letter?

This is not accurate. If you apply for AOS within a year of the medical, it's valid. It doesn't matter how long the AOS process takes, it's the date of application that determines validity. The OP's medical was well within a year of submitting his application.

@peanutismint Sorry for the wrong information. That was never my intention. I sure hope you don't need to get a new medical of any sorts given how exorbitant CS try to charge around here. Good luck with your AOS interview next month 🙌

Thanks all! I think as of now I'm just going to show up at my interview with my vaccination forms and hope for the best. Worst case scenario, if I'm meant to have had some medical form filled in they can deny me with a RFE and I can wait another few weeks/months for an approval. It's not like I haven't already been waiting years for a green card so what's a few months more....
