Hey guys!

 

I got a question. I used to live in the US 2016 -January 2018 with a J1 visa and I got a SNN.  I got married in December 2019 and we didn't applied for AOS yet. The person who did our taxes did not put anything where usually my number is supposed to be. Which we thought is how it is supposed to be.. We never have been married before and this has been our first tax filling together in the US as a married couple.

 

So long story short, my SSN says  "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" 

 

 

 

I do not work for the company anymore since 3 Years. We never got our taxes yet, neither the Stimulus and we don't know what to do to get it. 

 

Can we Use my old SSN ?

You could have claimed the stimulus with the 2020 taxes if you would be eligible. So you're here basically illegal since you got married in 2019 cause you're talking about AOS? I hope y'all use the tax money to finally file your AOS 😉

 

Oh and I had somebody at a bank asked me if my SSN is temporary. Doesn't surprise me that the tax accountant did what they did 😁

Looks like OP is a resident alien for tax purposes per the Substantial Presence test if OP has been in the US without status for the requisite amount of days: https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test

If you haven't filed yet, input your SSN before sending in the taxes. And if you meet the aforementioned Substantial Presence test, fix the credit amounts by also claiming the "Recovery Rebate" credit.

They only need to be a resident for tax purposes (which is not the same as permanent resident) and have a SSN. So OP is definitely eligible for it.

 I could care less about the Stimulus. My hubby would like his taxes very much ha ha since he is the only one being able to legally provide for us and it's impossible to reach IRS to get answers currently in this pandemic 😖

So what's the issue? 

 

Is your post about 2019 taxes or 2020 taxes?

 

You said you got married in Dec 2019, correct? So your husband should've filed as married for 2019 and 2020, and since you already had a SSN, he could've filed jointly with you for both years.

 

My suggestion is to check the copy your cpa gave you and see how they filed taxes for 2019 and 2020. If the cpa chose single for any of these years, then your husband will have to amend his return to married, probably jointly since that would give a better refund (own less money) and you could claim the stimulus check if the income was less than 150k. 

 

If the cpa chose married filing separately, then it's technically correct, but he can also amend it to filing jointly.

Use your SSN to file as married filing jointly and amend 2019 taxes to the same.

 

Tax-wise, getting married was the best financial decision I made.

 

Monthly expense-wise, maybe not the best.  Good perhaps...?  Somewhat good.  And by "somewhat" I mean not really...

Once you get issued a SN, that is your number for the rest of your life.  Once you get your greens card you can go back to the SS office to get that  "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" text removed from you SS card and your new married legal name.
