Good Morning

My dad passed this morning. I live alone, support system is mostly “virtual” at this point. Including any living family members who live across the country.

I have called USCIS to inquire about an expedite (I’m confused, numb state) and advised what happened. Hoping perhaps something can result, in me not being alone in grief for longer than need be. My dad was a best friend to me.

The waiting time was 30 minutes, the representative said this felt like it was a humanitarian request and submitted it on my behalf. 
Within 10 minutes I received a denial. I wasn’t expecting an approval. In the initial email, they said “Although your situation appears serious, the information you have provided is insufficient to establish that your expedite request meets the following guidelines” 

It was good to know they work... so quickly. While I grieve, maybe there is another opportunity to ask for an appointment expedite in Australia when it gets there... perhaps..
I wish I wasn’t alone. But, I guess life is like this. And sometimes out of our control our significant others can’t be there.

I am sorry for your loss.  It is wonderful to hear that the customer support person on the phone trying to help you with the expedite request.  But I believe you were denied because you would need supporting evidence, such as a diagnosis letter from a doctor or therapist.  

 

If you do try to expedite later, do it when your petition is approved and is sent to the NVC.  At that time, contact the embassy in Australia.  Some people make the mistake and submit the request to the NVC, but for K1 visas, the expedite request and decision is handled by the embassy.   Join the K-1 filers post for you month in the K1 progress forum:

If you want to be successful asking for an expedite based on your mental well-being, then you will need supporting evidence from therapists and psychologists.  Your words alone will carry no weight because death of a parent is a common event in the same vein as being pregnant and childbirth.  Pregnancy and childbirth alone is not enough for an expedite.  There has to be more.  US immigration can not expedite without supporting evidence of an extraordinary hardship.

Thank you. I’m ordering death certificate when that option becomes available in vital records. Should I need it for myself or if mental declines in the future (hoping not of course). I may try depending on my health & embassy appointment time is my next steps for the expedite.

 

I also agree that more supporting evidence on my mental well-being is needed but I’m staying strong. We are mostly towards our processing time, we aren’t in delays. The right time will come for both life events to naturally ride themselves through.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I’ve tried again. I got a USCIS contact right away. I’ve explained I’m alone, father has just passed. I wasn’t able to provide document proof because I did not receive an email to upload so she submitted a request for me again indicating I have documents to prove  my claim. Denied in 30 minutes without opportunity to provide documents from death, funerals, etc. 

Grief is very, very hard.

My condolences, Im sorry for your lost. Immigration ,unfortunately, sucks. I lost my dad last year too and got rejected. It makes grieving harder when you cant have your partner there. It will get better with time. Its something that is out of our control.
