For the green card?

H2b  is a  non immigrant temporary work visa, how do you intend applying for a Green Card?

That proposed change wasn't completely thought out. Something like "non-national" would at least make some sense.

From the bill: https://www.menendez.senate.gov/imo/media/doc/USCitizenshipAct2021BillText.pdf "by striking paragraph (3) and inserting the following: ‘‘(3) NONCITIZEN.—The term ‘noncitizen’ means any person not a citizen or national of the United States.’’

They are proposing to make every citizen of every other country non citizens.

...and by the way, if this past election is an indicator of anything, it tells us the country wants to lean heavily LEFT. If I was Joe Biden, I'm removing all the brakes towards a full head-on left dive.

Green New Deal, Immigration Reform, Student Loan forgiveness, Tax reform and everything in between. Go Biden and Harris!

Folks that have lived in "socialist" nations such as Venezuela, Bolivia and many others would vehemently oppose anything even appearing to "lean heavily left".  Don't believe me?  Go ask them.  Because unless one is hooked into the ruling party, they all know that the rest of society loses, and loses big.  It's exactly what Central Americans are leaving behind as they head north in caravans of thousands.  It's why Cubans will risk the ocean on a raft.  Pretty picture in the short run, disastrous future.  Always play the long game and strive for the common good.

Why does the world insist on repeating the failed systems of others in their own context?

If something sounds too good to be true, it usually is; especially when it comes from a political party.

Smart, controlled immigration has always been and will always be necessary in a healthy society that wants to have an identity.

They should just rename it to "future citizen".  Technically speaking, it would be more accurate to rename them to "criminal" but that's just my opinion.

Oh good, so there's no more penalty for overstaying.  Well done Mr. President.

I see several things which will create an enormous backlog in the system......ENORMOUS backlogs!!!  Exactly where are they going to find the people to process all these new visa holders and new citizens?

Most of the proposed changes have long term impacts and will require a significant increase in processing capability. Unlike DACA which was more a blip, so you would hope that would be something that would be taken into account in resourcing USCIS etc.

Under the new law, if passed,

  • A false claim to U.S. citizenship would no longer be a ground of inadmissibility or removal if it was made before the person turned 21.

Will this have any impact on the K1 process? We are waiting since Jan 2020 to do our final interview and to move over to Michigan.

Most likely.

I guess that would be similar to the current adjustment of status process - the system assumes you are eligible (you can get an EAD, get ACA insurance, etc) until you are determined to be ineligible.

There is also the enhanced V Visa

One thing that comes to mind about the V visa -

Taxes would need to be filed for those working while waiting for their priority date.  It wouldn't be surprising if V visa holders had to file something equivalent to a 1040NR (non resident).  This would probably prevent them from getting the standard deduction, so it would be more tax revenue for the US.

I see the logic (age of majority)

In fact, as the law stands, some lawyers have been able to argue that their client did not understand what it meant to be a citizen or national.

If they enter in the first half of the calendar year, then they'll be resident aliens for tax purposes because of the Substantial Presence test: https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test
