Ok so July 30th is the magic day.

For AOS,EAD and AP considering all the quick AOS's should I save the AP cash and not file it (the AP)? How about EAD?

And doesnt AOS cover EAD and AP even if didnt file those? I'm in a position that I really dont need my fiancee Nancy to have to work anytime real soon, I want her to take some time off and relax a bit. What do you all suggest?

Here is my current timeline:

At the moment she is coming from HongKong transiting thru Chicago to Toronto on the 3rd, if she makes it thru, I will be driving up on the 4th from Houston to go get her and then spending about a week in Canada. If she doesnt get thru and they activate the VISA, our plan is to get married ASAP, start filling out the AOS paperwork, wait the 2 weeks, and then get her SSN.

Your input is much appreciated.

The POE is Chicago but she is going to tell them she does not intend to activate the VISA at this time as she is transiting to Toronto and then she will activate the VISA in about a week when cross the border by car.

Good luck with that, I have no idea if it will work. She is entering US soil, so I kinda doubt it. Is it a connecting flight or 2 separate flights?

Apply for AP/EAD if you feel you want to as insurance. There are no guarantees of a quick GC.

I think they're planning to spend some time in Canada before she moves here, but she has a connecting flight in Chicago... which will most likely result in that being her POE... in which case they're going to ditch the Canada plan! Am I right?

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

That is correct. She has a connecting flight to Toronto, if they activate the K-1, I will just buy her a ticket to come on down to Texas :P otherwise my intent is to drive to Canada.

That is correct. She had a connecting flight to Toronto, if they activate the K-1, I just buy her a ticket to come on down to Texas :P otherwise my intent is to go to Canada.

Seems like a lot of effort & $$ for a what if. Couldn't she have just booked a HK-Canada ticket?

She got the ticket without telling me that part of it, its ok we will work with what we got. Live and Learn :D

They might not activate it since she's going BACK to Canada and Chicago is only the connection. But you have a good back-up plan regardless. :)

Any chance of her changing her ticket to HK > Vancouver > Toronto?

Unfortunately not, she is flying United Airlines and it doesnt go that way. :(

I talked to the supervisor there in O'Hara on the phone and he said they would let her thru as it would only be for a few days til we crossed the border to activate it and if she had a problem to ask for a supervisor. I told her if they start making a big deal of it, be as nice as possible of course, to just activate it.

If one want to have employment authorization they have to apply for employment authorization, using for I-765.

If one wants advance parole they have to apply for advance parole, using form I-131.

I love this "activate the VISA" language - it brings out the George Carlin in me. The visa is active as it comes from the consulate, folks - one can use it to travel to a US POE and request admittance. It is de-activated upon admittance to the USA - it's a one-entry visa and once admitted the visa can't be used again. (Except in a certain circumstance where one can return to the consulate and request that the consulate re-activate it.)

After landing in Chicago, can your fiancee get from the arriving plane from Hong Kong to the departing plane to Canada without passing through immigration inspection? If so then your plan will work. If not you'll most likely have to dust off Plan B.

I'm pretty sure she has to go thru Immigration check, but its killing me I tell you not knowin for sure as everything I research gives me different answers, hell even the Immigration people have given me different answers :P

These last few hours are driving me insane I tell you!! lol we are about 72 hours away now and counting down.....tick tock TICKY TOCKY!! <crunch goes the gear as it moves the second hand> what just a second has passed, what the he!!

Yah, I'm thinking we are going to have to use Plan B also <tears more hair out>

Ok I will make sure we will file for all three then.

Ramos,

What gate is she entering at? What gate is she departing from? Have you tried looking at a map of O'Hare Airport (or Midway, whichever she's using). That might give you some idea, would certainly let you see if she does have to go through immigration for sure.

As the supervisor says, it probably won't be a problem. I crossed the border numerous times during the 6 months I had the visa in my passport, and I know others have also. (I didn't use my visa until 2 days before it expired.) As long as you let them know when you are planning to use it they are fine with that. (During some crossings they didn't even remark on it.) However, as we all know.... some of the best laid plans... LOL. Good luck!
