Marijuana admittance (Jamaica) K1 Visa

So I just want to write this to ease some people’s fears about this one year ban for admitting past use of marijuana at the Visa Medical.

 

reading through the forums on this website drove me crazy and had me so scared to think that my fiancé would be denied a visa for a year because he used to smoke in a country where weed is decriminalized smh.

 

i just want to say My fiancé did admit past use at his medical appointment, he admitted to using 3 months prior to the medical and admitted to using once or twice a month(he’s not a heavy smoker) and yes he did have to see a psychiatrist afterwards to determine if he was a drug abuser . 
 

he went to his interview and passed with flying colors , and they took his passport and his medical was received by the consulate AFTER the interview. We were worried that he would not get approved with the administrative processing but his visa was ISSUED. And He is flying out in 2 days. 
 

I can’t say if it was just luck or if it was because the medical wasn’t at the interview for the CO to question him about the drug use , or maybe it’s because there is a new Administration(Biden Administration) ,I just  don’t know. BUT... there are not many success stories for marijuana use and I’m sharing ours.

 

Don’t worry , it may just work out. Don’t keep reading the forums about it because it will drive you crazy and discourage you just like it did for me. 
 

I hope anyone else in this predicament can have the same happy outcome as my fiancé and I.

Thanks for sharing Good news.....This has nothing to do with the Biden administration.  As it has been for years, Marijuana is not legal federally, and it has always been at the discretion the medical professionals and consulate officer to evaluate each case.  I would caution everyone that any case is subject to a one year ban if the consulate determines.  I'm glad it worked out for you.  Thanks for sharing.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ugh not my experience. Currently in our 1 year ban that started Nov 2021 -- we have a one year old -- I applied when I was pregnant - we've had one test since the ban. I'm so over this. But yeah who know why you got through and why we didn't. My husband is an artist -- so most likely his public presence and career gave them this impression. Guess we will just keep waiting until Nov. 22 and hope for the best. Wondering if I should even bother and try to applying for a 601 waiver. or if that step comes after "worst case scenario" :( sigh
