Our case (AoS from H2B) was received on Jan 11th, and we tried calling two days ago.

 

The first agent said that biometrics were being waived more regularly. He couldn't tell us if my husband's was being waived or not, but he did say the current EAD timeline is 9-11 months.

 

This sounded so preposterous to me!! So I made my husband call back to see if we could try expediting. The second agent was a lot less chatty. We simply asked if we could expedite and she asked us for what reason (she read off a list of 7 reasons?), we said financial hardship (I am a grad student and can only rely on student loans and generosity of my parents for so long!), and then she gave us a reference number starting with T1M and ending with MSC... The whole conversation lasted about 5 minutes, it sounded like she read from a script, but I appreciated how straightforward it was.

 

Judging by other comments, it sounds like the biometrics were indeed waived if we were able to expedite? And does anyone know how to track the reference number for the expedite request?

I requested to expedite my EAD and I was notified via the immigration case tracker and the lawfully app that an expedite request has been received. I reached out to immigration two mornings ago via Emma and it was updated yesterday. Not sure if they will ask for evidence but hoping it has triggered something to move because I haven’t had my biometrics yet.

No biometrics yet here either -- we filed at the end of January and my husband is adjusting from an L1. We're lucky that he doesn't need an EAD or AP immediately but it's just frustrating having to wait for the green card with the understanding that it could easily take another year. When I did AOS with my ex at the very end of 2010, it took us 5 months from start to finish!

Just checking in, anyone have any new news with their application movements? We've had nothing since biometrics were taken in March.

 

We tried to expedite the EAD, as I'm in kidney failure and need him to have a SSN to get good medical coverage in order to test to be my donor, but we were denied due to medical issues not being a reason to expedite. That was April 21. 

 

So, we're just sitting here twiddling our thumbs now and waiting still!

@myperfectflaw SSN is not required to your spouse to your health insurance. Most insurance companies use a placeholder number (111-22-3333). 

The easiest way to expedite would be for him to get a job offer - any job will do. 

 

Alternatively, you can reach out to your US senator or US congressperson and ask them to speak to USCIS on your behalf and place a request to expedite his EAD/AP. (If you are asking for one, you may as well as for the other).

Timeline

AOS sent January 30th. Tried expediting EAD with job offer in begining April and got denied for lack of biometrics. Biometrics on May 3rd and second expedite request on May 5th. Got an RFE asking for more financial evidence for I485 on June 1st, so my expedite request was placed on hold with my complete case. Response to RFE package sent July 7th, now waiting for my expedite request to be granted while the rest of my adjustment of status is processed. No clue about time frame, I've had job offers since beginning of March, yet here we are.

 

But I feel for you that haven't even gotten biometrics letter. I would say to contact your rep and put pressure through them.

Also no biometrics letter or any other movement! I did try to expedite for my husband's EAD but we were denied on June 24th. Other than the denial, it's been absolute crickets since Jan 11th receipt of our I-130/765/485 package (other than a Jan 24th fingerprint fee receipt haha).

 

We're moving to another state at the end of August, does anyone know if that will negatively impact any of our applications? I'm waiting until closer to our move date to notify USCIS of our change of address.

 

My husband wants to try and strike it out on his own with a small business, but I know he'll need his EAD for that. Would contacting our local representative be the best way to try and expedite that EAD for his self employment? I'm assuming I should wait until we move to our new state to do that?

Can't really tell you whether moving would help or hurt. I would look at the USCIS processing times. In my case we moved from a slower area to a faster area but I suspect that may have slowed our case. You might consider dragging your feet on updating your address if you can afford to fly back to the old area for bio and interview. I wouldn't wait too long though. 

As for contacting reps, I'd contact anyone that might help. Those for your current address and then the new one.

I would just try to expedite the EAD again. The easiest way is if he has a job offer. When you request to expedite, make sure to mention the AP. It takes the same background checks and effort to approve EAD or AP or both. That way he will have a combo card. 

 

You can certainly reach out to your US Congressperson. It would not hurt. 

 

There is no way to know whether  moving will delay his AOS process/interview. In general, you could say that it depends upon where you are moving from and where you are moving to. Some field offices are just faster than others. Right now, though, it seems like every field office is backed up.

Same for my wife.  While the 130 has to be submitted and approved, I don't think it actually does anything for you.  Just part of the process.

@christophec congrats on your mom's approval. It means that you proved to USCIS that she is an immediate relative of a US Citizen. That is 50% of the battle. The I-485 determines whether she is admissible and eligible to adjust status in the US. In other words, the I-485 determines if she can get her green card here without having to go to her home country and get it at the Embassy. 

 

USCIS tends to waive AOS interviews for parents of US citizens. My mother got her EAD 90 days within filing and green card in the mail within 6 months. Did you submit the I-693 Medical? If you submitted, they may just move forward and waive the interview. 

 

If you did not submit it, and they want to waive the interview, they usually issue an RFE requesting you to send it. Then they waive the interview.

Yes I submitted i130-i485 all together with all the required paperwork.

6 months seems very fast nowadays to be approved
