K Visa Processing Update _ Feb.10th 2021 on DoS

Hi,

 

Here is the latest K1 Visa Processing Update I have read on the DoS website,

Could anyone help let me know what it means by "the applicant is eligible for a National Interests Exception."? What is the National Interests Exception? What will fall into the scope of National Interests Exception? Or how the applicant could be qualified as a National Interests Exception? 

 

What could we do or is there any suggestion for the k1 applicants who are currently not in the plaintiffs in Milligan v. Pompeo and who are physically present in a country covered by COVID-related geographic proclamations? Join the plaintiffs? (understand the 3rd round deadline to join was Feb. 15th, 2021, don't know what will be the best premises to join, we have got our NOA2 last month and waiting for the welcome letter case # and such from NVC right now?) Or just wait (We haven't seen each other for more than 13 months now)  ... or anything else we could do about it or expediate our case?  Don't understand why mainland China is still banned ... we only have around 10 confirmed cases every day in the mainland China and majority of these 10 cases are imported ones ... I haven't seen any local report on variants either. Appreciate any suggestions or sharings from your end. Thank you.

On their website, they say "K visa applicants who are not plaintiffs in Milligan v. Pompeo and who are physically present in a country covered by any of the COVID-related geographic proclamations (the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, Brazil, or South Africa) will not have their K visa application processed unless the applicant is eligible for a National Interest Exception. " that's the reason I have posted my questions in my post above. Thank you for your thoughts, suggestions, sharings or anything.

Hi all,

 

What is the meaning of processing in the context of this update? We have our NOA1 from August and are waiting for NOA2 (hopefully soon given July ones coming in). Will this still be processed given the UK is on the travel ban list and it will not be processed for now at the embassy? Or will we not be getting an NOA2 processed at all for now?

Hi. I am in the same situation as you. My fiance lives in China. His friends are also in the same situation. They received their NOA2 before covid started but Guangzhou consul is not scheduling interviews. I received Noa2 in Jan. I still dont have a case number but I joined Milligan v Pompeo round 3 because that is the only way I can get him here. The lawyers said you do not need a case number from NVC. Maybe you can try to apply still. It took me about 10-15 mins to submit everything honestly. Im glad I took this decision.

"Getting an NOA2 processed" isn't a thing.  What you are currently waiting for is adjudication and approval of your I-129F petition, at which time the notice (NOA2) will be mailed to you.   Petition adjudication and approval takes place in the US, at the USCIS center in California.

 

Once approved, the petition is sent to NVC to wait until requested by the consulate.   Prior to COVID, that was a very short wait of only a couple of weeks.  Now, folks with approved petitions have been waiting for a year.

 

When your petition is approved, it will go into the queue behind those waiting.  How long for anyone to get interviews from there is anyone's guess.

You’ll still get an NOA2 as USCIS is still processing but then it’ll get stuck at NVC. No K1 interviews in London since March 2020, only plaintiffs in Milligan vs Pompeo.

@ callmeshelle or anyone who could share with me how to join the Milligan v.s. Pompeo litigation, I have just checked the visalaw.com (https://www.visalaw.com/k-1-litigation-new-plaintiffs-onboarding/), I couldn't find anything there, maybe that's the wrong place to look for. Thank you for your help in advance.

The deadline for Round 3 was Feb. 15.

 

The lawyers for the Plaintiffs say they'll try to make the judge's order a wider/universal relief: https://www.facebook.com/kuckimmigration/videos/the-siskindjosephhallkuck-update-on-pending-litigation/250071949899560/ (Start at 7:06) But the government lawyers have said they'll fight that motion:

IMO, odds are that the Plaintiff lawyers would win on that motion.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
