My wife just got her interview letter for her K1 adjustment of status, scheduled for March 16th. The letter says to bring form I-693 and form I-864 if required. However I'm unsure if we would be required to fill out those forms again.

My wife arrived to the U.S. on Nov 20th 2019, we were officially married on Nov 22nd 2019. Obviously at some point during the process of the K1 visa we filled out thes3 forms but I'm unsure if they're still valid.

 

I hope somebody more knowledgeable can help me out so i can jump on getting these forms before her interview comes.

K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

  • The medical examination did not reveal a Class A medical condition; or 

  • The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27] 

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28] 

 

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician. 

 

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If you did not include 2019 tax return on your original I-864, you may need to prepare a new one with 2019 taxes included.

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

We had my wife’s AOS interview a few weeks ago. A new I-864 was not necessary, and we were not asked for any additional information. The officer simply saw that it was there, marked it with a red pen, and moved on. I generally think it’s a good idea to update the information, though, and took my 2020 tax return, 2020 W2, recent pay stubs, and an updated employment letter just in case. None of that was asked for.

 

The only thing which was requested during our AOS interview was the DS-3025 immunization report. A new I-693 isn’t necessary if it was valid at the time you filed for AOS.

Can you tell me where you get the DS-3025?  Is that something from the original doctor that did the medical in the fiance's country?  Did you need to get it directly from that doctor, or is something you fill out yourself?

The doctor may have provided a copy:

The doctor also sends the original to the consulate, and that original (or a scan of it) eventually makes its way to the A-file. https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-3 "An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file."

The panel physician who conducted your K1 medical should have filled it out and sent it to the consulate. They are also supposed to send a copy to the K applicant for safekeeping. The DS-3025 is already likely in your file with USCIS, there’s just no way to be sure that it’s there and sufficient unless the physician gave you a copy. Sometimes things get lost in the shuffle between consulate, NBC, field office, etc. We were asked for ours because the USCIS officer saw that we had it on top of our stack of documents and it was easier to ask than to scour through the massive file looking for a single sheet.

Thanks for the replies and info ^^

 

I confirmed with my fiance that her doctor did not give her any paperwork for herself (he only gave her a sealed envelope to take to her interview at the consulate).

 

So we don't have copies of any of it, no DS-3025 nor I-693.  My fiance is calling her doctor back in Poland as I type to see if they will send her a copy.  We shall see...

 

Is there a way to get a copy from this "A-file" that was mentioned above?

For a majority of K-1 AOS cases I-693 is not needed:
