Hi,

My husband I have filed for K1 Visa in December 4th. Even though we are based in  California, we sent our documents to the Texas office because that is what is said to do on the government website.

It's been over 2 months now and we still haven't got the NOA1. We have called and they told us to email the lockbox. The lockbox said that it is taking a long time because of the pandemic. This is understandable but 2 months seem a bit too much.

Can anyone give us some information? Is this too long? Are you in the same position? etc

Thank you

1st point: Husband disqualifies you for the K1. You should be applying for CR1

2nd point: Yes, with COVID they are behind in processing NOA1s. You should hear back end of this month and they are back dating to the date you submitted

Yes there are many December filers still waiting for NOA1:

Thank you! Like someone else commented on that blog, the government should really do step this up. Many US citizens waiting to start their family. It's taking a toll on people's wellbeing

I understand your frustration. We also sent our form last December. It's still on a case to case basis but people who sent theirs on November have been starting to receive their NOA1. Our are coming up anytime now.

Keep an eye on the November and December filers threads in the K-1 Visa Case Filing and Progress Reports sub-forum and participate in the December thread: those are your people now, and their progress will inform yours!

We're all in the same boat. I (Nov 12 received date) just received my NOA1 a few days ago, and USCIS is catching up fast after a period around the holidays of no movement. You'll get yours soon, and good news, they're backdating the NOA dates to when they received our packages, so these three months will count towards our NOA2 wait times.

That's really good to hear about our wait time count towards NOA2!

That is always the case. See 8 CFR § 103.2(a)(7)(i): "USCIS will consider a benefit request received and will record the receipt date as of the actual date of receipt at the location designated for filing such benefit request whether electronically or in paper format."
