LOL   the only whining were going to hear is from the litigants who got ripped off for $2500 and are still apart from their Fiance's...  Words like "cautiously optimistic" are merely a hook,  a hook to reel in desperate petitioners who've been apart from their Fiance's, and who feel they have no other recourse.  Even if by some miracle this Class action lawsuit is successful, the plaintiffs named do NOT have priority ahead of other K1 Visa applicants, meaning they still have to wait for the backlog in front of them, did you know that?

 

This is what I don't understand about you,  your NO2 is in May 2020, that means you only have a 2 month backlog in front after the embassy reopens, which is expected soon now that vaccinations are underway in Manila, and yet you're joining a class action lawsuit? or is this more about promoting one?

 

And I most definitely will be with my lovely Fiance for Christmas and for New Years,  regardless if she's here in the US or the Philippines, since Foreign travel into the Country is already opening up,  For $2500, I could book 2 round trips plane tickets and it would be a sure thing that I would be with her,  unlike rolling the dice with a group of greedy and opportunistic lawyers.

Yes dude. You could surely book round trip tickets to see your fiance in many parts of the world starting Dec 2021 (assuming everything opens up) But you are always gonna do that and see her in Maldives, Dubai, Costa Rica for only a few weeks at a time? Up to what point in time will you eventually marry her- 2023? 

Fyi. Google about the Milligan vs Pompeo lawsuit. The first rounders got their interviews. Oh wait- were they ladies who chose military men, did they make babies with them before the wedding? Oh no. They did Not qualify for the expedites yet the lawsuit worked. 
 

In August 2020, the travel.state.gov statee this line “k1 are now given priority. But this depends on post-specific conditions. “ that was freaking 2020.  Wth happened to USEMB Manila?

 

This statement was only put up in that website because the state learned of the brewing Milligan Vs Pompeo Lawsuit and they had to Make that press release that K1s are being processed so the assigned Judge in DC state will see to that when the preliminary injunction was filed in October 2020.

 

Wait for the embassy? Dude, US EMbassy Manila alone has got 9,000 k1 applicants waiting to be interviewed. 
 

An online  Interview will

never be done because the K1 is the most notorious visa application. The strictest and trained Consular Officers in the universe were planted by the Immigrant Visa chiefs of the State in US Embassy Manila because we got the highest number of k1 visa Applicants in Planet Earth. Go to travel.state.gov and in 2019 alone 7,134 k1s were issued. Highest in the world. 
 

Manila Also is notorious for having couples with age gaps between petitioner and beneficiary of 20 plus years and up. Thus every CO is trained to check the body movement of the applicant, hands, eyes the way she talks even if it is only a 3-minute interview. 
 

You clearly got the money to Join mandamus lawsuits but you choose not to. Well it is your call bro. Do not wait for the day that your lady-love will whine to you in the future telling you “babe i wish we joined them. I see their wedding pics on Facebook. “.  It is your call. 
 

Legal terms:

Plaintiffs not litigants

The Milligan vs Pompeo and the new Manila Mandamus are not class action lawsuits. They are called Mass Litigation only. Class action lawsuits takes years and will also benefit non-paying applicants. It has never happened in the history of K1.

Where did you get this incorrect information?  Philippines is going backwards, they are going back to curfews and quarantines in many parts.  Especially Manila area, they just extended the lockdown there for another week, and I suspect it will be a trend for them to keep extending it for a while.

I know the lockdown was extended, I spoke with Philippine airlines direct 3 weeks ago, they are taking foreign travelers who submit to a Covid test or have been vaccinated, no quarantine.. They desperately want to open up foreign tourism, it's the life blood to their economy.. Please give PAL a call to confirm..

The only two items missing in your post is an "Attorney at Law" business card and a set of pom poms. 

 

Like I stated before, even if the case is successful, applicants remain in the backlog, they don't skip to the front of the line.

Why?

 

I have trip booked in May of this year, it was rebooked from last year, I booked it out 1 year hoping this would be over with.  I know this trip will be canned as well.  I am thinking it will be 2022 when the Philippines opens back up,  I am hoping it opens up my 4th quarter of this year.

 

Of course PAL want to open up, they are dying so is many things in the Philippines that deals with hospitality, hotels, entertainment, bars/clubs.  Even the cases of people getting bit by street dogs are rising since the street dogs are starving.

The lawyers and actual people in the Milligan case who have won would disagree with you. If there’s an order from the judge, those plaintiffs get priority. Do they go in front of a case that’s actually being processed? Probably not, but they do get prioritized over others. Generally the embassies would like to get lawsuits out of their hair as quickly as possible, and just adjudicate the cases to get it over with.

The last update I saw, we were at 144 registered couples. It could be more now as that was when the deadline ended. The planned filing date is some time next week. They stated they are still accepting cases for onboarding if you were on the fence about joining!

Is there any update on this?  Last I heard the USEM said they will not put plaintiffs in front of others who are waiting?  How is it going?

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's odd - then what was the point of filing the lawsuit in the first place? As far as I remember, the original round 1 of the Milligan vs. Pompeo lawsuits got interviews for all the plaintiffs, ahead of all the others who didn't join the lawsuit.

Milligan went after the lack of interviews because of a federal travel ban.  A few couples got interviews but couldn't afford 14 days in another country so their visa expired with medical.  Most did get interviews and approvals.

 

Manila only had local conditions as a real excuse so the case wasn't as strong without suing the local government for the quarantine.  Manila, in my understanding, was more of a Writ of Mandamus case.  They can win the lawsuit but still see no real advantage...all in all, it is a good year for the lawyers.

Ouch. We'll see if Daniel or one of the other plaintiffs responds. What a sad situation all around.
