petition for sister's family. how? which form?

Hi everyone, I'm glad I found VJ. And I came here to seek advices from you all.

My mother (became US Citizen recently) has one beloved sister in Vietnam; but for now, she'd like to petition immigration visa for her sister's whole family. Her sister's family composed of 5 members: my auntie, her husband, her 23 yrs old unmarried daughter, her 25 years old married son, and her 16 years old son. I've searched several posts and read I-130's instruction but still unclear of what scenarios will happen. Seeking a lawyer's service is the last option if I find no solution from you. Please help :help: as I need as much information as possible before the new fees schedule comes.

As I read somewhere that it would take 12 years to petition brother/sister in Vietnam. And between petition filing date and immigration visa available, the benefitee(s) of the petition "CAN NOT" comes to US for any reason (visit, different visa as in worker visa, student visa). As I know of my auntie's intention to migrate to USA, would it be a conflict if later on her 16 years old son want to attend college in USA? I'm not planning but thinking of several scenarios and would like to check your opinions:

a. my mother petition for her sister, her sister-in-law, her niece & her older nephew first so that would leave her younger nephew out and he can apply for student visa as whenever he wishes to? Whenever my auntie becomes USC, she can petition for her son?

b. Same as option A but add-on her younger nephew later on if he doesn’t want to attend college in US?

c. There are several jobs in America that would give foreigners green cards (I only heard rumors), can my cousin apply for it and whenever she/he become USC, they can petition for their parents?

d. Or the simplest thing for my mother to do without the headaches is “petition for all 5 persons of her sister’s family”?

e. Others?

By far, I only know of such information; and I haven’t talk to my auntie’s family directly (only through my mother). So there’s no fraud or anything in this post. As I stated, my auntie’s intention is to migrate to US, and that is my mother’s intention also but my mother is already a US Citizen.

Please help with your opinions and details of forms, timeline – like how long approx, which is better scenario. Or if you have any question please donot hesitate to contact me by private messaging or email. Your respond(s) would be really helpful to me even a “bump”. :help:

Try longer than 12 years, one poster said father petitioned for his brother, and has been waiting almost 20 years.

Siblings and spouses and children of siblings are Family 4th Preference, the lowest priority for visa numbers.

LIMITED FAMILY-BASED

Family Fourth Preference (F4): Brothers and sisters of United States citizens, and their spouses and children, provided the U.S. citizens are at least 21 years of age. (65,000)

Your mother would file form I-130 for her sister, her sister's husband, and any children of her sister.

To file for a sister-in-law she would have to file for her sister-in-law's husband, (her brother)

The 2 older children are too old now, not sure about the younger one, I think it is when the visa number is allocated in which case he would be out as well. No harm him going for a F1 anyway.

Once here under current regulations the parents can sponsor the childen, but we are talking decades.

Say 12 years for Parents.

6 years to get Citizenship

9 years for married children

Assuming they are married of course. Marginally different if they are not.

Anyway not something you would want to plan your life around.
