Tax document clarification.. if someone could help please

If anyone has advice they could give me..

 

I'm trying to file an i485 in conjunction with i130 for my wife who is lawfully in the US. On related form i864 Affidavit of Support, part 6 23.a it states "You MUST attach a photocopy or transcript of your federal income tax return only for the most recent tax year".

 

It will be awhile before I can get a transcript because I need to help my wife get an ITIN before we can even file. I can, however provide a copy of the 1040 I have completed and ready once we actually have an ITIN.

 

When they say they want a photocopy of your federal income tax return, does that mean a copy of the 1040? Any advice on how to proceed would be greatly appreciated.

A copy of the tax return means a copy of the complete 1040 package you filed including schedules, etc.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you. When you say schedules do you mean W-2's and 1099's? Sorry if the question is simple I just don't know. The only tax documents I will have to submit are 1 W-2 from my employer and a 1099-B from my brokerage account. The 1099-B is the first thing I'm waiting on, it's supposed to be available today but isn't yet, and I read that some people from my brokerage have gotten emails saying it wont be available until mid-March. I have not received that email but it isn't available. The other thing and the main thing is the ITIN, I won't have that for another month according to what I've been reading online.

I mean the complete package.  For example, a self-employed person might have a Schedule C, etc. in addition to the 1040 form.  Yes, W-2s and 1099s should be submitted as well.  

 

BTW, I think 1099s are required to be sent by Feb 1st.....

Ahhhh that makes sense, thank you for clarifying!

 

As for 1099's, you're right. Many of us who use Robinhood are pretty upset about the whole thing. My understanding is that they have until February 1st but they can file for an extension with the government and regularly choose to do so. My gripe is that it first said on their website "Before February16th" and now it says "February 16th". We only have 16 hours left of February 16th here in CST and I am still without my 1099, the bastards.

My Robinhood Crypto 1099 is ready today, so they may be done by the end of the day.

The most recent tax year is still 2019, so that's the one you should be sending with your package. Don't delay filing for AOS because you're waiting for 2020 transcript.
