RFE taking longer than 4 weeks (Dec 2020 K1 RFE)

Timeline

March 2020 filer here. California Service Center. 

 

Submitted I129-F 3/16/2020

Got receipt number 3/24/2020

RFE Requested on 12/17/2020. RFE was for requesting an updated passport photo of the petitioner and proof that we were together in the past 2 years. 

RFE Received by USCIS 1/4/2021  

 

It's been more than a month and I haven't heard anything back. Anyone else in the same boat? I emailed and called USCIS but couldn't get any meaningful update besides they are working on it.

They try to process RFEs within 60 days. In more complicated cases it can take longer than that. So you’re well within a normal timeframe. 

Thanks powerpuff! Still nervous since I see other people's RFEs get approved in 1-2 weeks 😕

Timeline

Submitted a case inquiry on 3/4/2021, got response in email back on 3/12/2021: 

 

"On 03/04/2021, you or your representative contacted USCIS concerning your I-129F to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

Your case is currently being adjudicated. You should receive a notice of action* within 45 days.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice , Request for Evidence, or Notice of Intent to Deny."

 

Also called USCIS tier 1 and escalated to tier 2, the tier 1 rep. said I should get a call back by 3/26 (14 business days wait time). I couldn't get into the urgent wait queue :(

 

 

Is anyone else in the same boat where the RFE response is taking longer than expected?

Your mileage may vary, but based off the previous person's RFE received date to NOA-2 date (I grabbed this from their timeline and compared to yours), there is a chance you might see yours at the end of the month.  This is pure speculation.
