i130 filing question (merged threads)

Recommended Posts

For those who are US Citizen and have filed i130 for there wife to come from India. Assuming the file is perfect, no issues. What is the minimum waiting time? 
I am looking at the timeline VJ provided, but its really confusing. 

 

Many people say 15-20 months. Others say as early as 8 months. I don't know what to beleive.

Expect a minimum of 12 months from the time you file an I-130 to the time an interview takes place; that goes for any country, not just India.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Timeline

We are all guessing.

 

Pre Covid I would have said 12 to 15 months.

 

Now with a big backup to work through? And Consulates have not resumed normal processing.

 

Now there may have been a drop in the number of applicants, also an unknown.

 

So my guess is we are looking at nearer 2 years,  but it is a guess based on the above.

 

I remember when I went through the process being overly focussed on time lines, mine was 6 months longer than I expected.

Filing for I130, What additional relevant documentation was provided by folks of VJ? the instructions state: 

(6) Any other relevant documentation to establish that there is an ongoing marital union.

 

NOTE: You must submit clear and convincing evidence that you and your spouse entered into the
marriage in good faith and not for immigration purposes if you married your spouse while your spouse
was the subject of an exclusion, deportation, removal, or rescission proceeding (including during the
judicial review of any one of these proceedings); or you are a lawful permanent resident that obtained
your permanent residence through a prior marriage that was not determined by the death of your
spouse and you are filing your petition for your spouse that you were married within five years of
obtaining your permanent residence.

Timeline

Wedding photos, joint bank account statements, spouse added to health insurance, beneficiary of insurance plans, other photos with family, photos of being together (holidays, vacations, visits to each other's country/home), travel receipts and passport stamps when you visited your spouse and vice-versa, etc.

 

Any photo should be labeled with event, place and date (Like Christmas at her/his home, Dec 2020).

Hi, I have 2 queations regarding the i130, i130a petition filing process. If I do via online, do I need to upload petition by petition? Or i need to combine everything and upload 1 big file? 

 

Also, I plan to submit the following supporting evidence to prove i have a bona fide marriage. Please advise if this is enough. 

 

1. Marriage certificate in English 

 

2. 2 passport style photos (2x2)

 

3. Picture of the Wedding card in English showing parents info, date of marriage, location of marriage and hall name. 

 

4. Pictures of my marriage whereby a lawyer is sitting and watching myself and my wife sign the register book including the religious priest who is watching us as well. 

 

5. An affidavit from a person who attended the marriage including all his personal details (date of birth, how he came to know about the wedding, etc)

Have you read the guide here?    You seem to be short on 

 

Evidence of a bonafide marriage

 

from that guide:

 

 
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financial resources; or
4. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
6.

Any other relevant documentation to establish that there is an ongoing marital union.

 

 

where affidavits are the worse forms.   Pictures of the those of you together,  with family members would a really good item.   Also ticket stubs from your visits,  and/or passport stamps.

 

As for your questions about online filing and the forms,  the i130 is done on-line.   The i130a and other items will have places to be uploaded separately.  The only combining will be if there is a translation to a document, the original and the translation should be uploaded together.

M is my middle name 

Then list Monty as your first name and M as your middle name on the I-130.

 

US passports list given name as the first and middle names.

Hi, I am starting to complete i130 online. Seems very easy and straight forward. Just have a few questions 

 

1) will the USCIS website prompt me to complete i130a, and g1145? Or that I will need to send by mail and do only i130 online? 

 

2) as I understand, paper mail requires a cover letter. Is the same true for online application? 

 

3) USCIS instructions require 2 passport size photos with the person name on the back of the photo, this will require me to upload 2 pics (front and back)  will the online app allow me to upload pics like this?
