Personal statement of military compensation

Hello everyone, especially those familiar with military immigration. I'm petioning to bring my dad to the U.S and currently working on his affidavit of support.  My w2 only list my basic military compensation which is just $25000. My personal statement of military compensation list all my allowances and special pay which brings my complete total compensation for 2020 to $55,000. My question is, should I submit both of these documents with my affidavit of support or just one of them.  Thanks

W-2s are not used to determine current annual income.  They are only used as supporting documents for tax returns.  To properly calculate current annual income, use the gross income/allowances from your monthly pay statement x 12.  That equals your CURRENT annual income.

If you submit a tax return along with the I-864, you will need to attach your W-2.  If you attach a tax transcript along with the I-864 (at the appropriate time), you do not need the W-2.

Yes.....or you can just submit a tax return with the W-2 as required by the I-864.

No.  It will reflect only what was reportable to the IRS in past years....it does not reflect your total income (and allowances) for a year.

1.  For immigration purposes, a Consulate Officer is most concerned with your ability to sufficiently support a new immigrant.  That is why what you CURRENTLY receive in income and allowances (monthly pay & allowances x 12) is king.....not what was reported to the IRS last year.

2.  You are required to submit a copy or transcript for the most recent tax year. (At the time you submit an I-864)

These are two separate requirements.

Hi, my husband is active duty and my green card just got approved this week - for the I-864 we originally included:

- LES from the previous 6 months of employment

- 2019 IRS Tax return transcript (from IRS website)

- 2019 IRS wage and income transcript (from IRS website)

- 2019 W2

 

We took 2020 W2 and certificate of military compensation to the interview last week as extra documentation just in case, but didn't need them.
