hi, we are just about to start AOS and I don't know where I can get ahold of my fiance's original K1 packet.. the one in the mysterious brown envelope we turned in at POE. Where does that go? We turned it in in Houston and are now in Tacoma, Washington. Specifically, I would like his birth certificate back. When I asked for it at the Embassy, they told me to ask for it at POE, and POE said they were not authorized to change it for a photocopy. Are there other things I need, such as his medical report, that I should request? Where can I request those documents?

(I know, we need to be married and have the cert. before we can start AOS. )

For all practical matters you cannot... they are a part of the permanent immigration file and is now property of the US Government.

No getting them back, when my fiancee got things like birth cert, police cert etc, we got a few extra copies knowing that anything turned in to the consulate we would not get back.

You will have to somehow order another birth cert from foreign country.

You only need to take care of vaccination requirements for AOS, not the whole medical.

Lastly, when you do file AOS do not send any original documents in that package, USCIS will accept simple copies, Only originals should be the application forms them selves (I-485, G-325A...)

Please read the instructions for I-465 filing to determine what you do in regards to a recent K-1 medical...

You may try filing form G-884 for the birth cert, but good luck.

you would be quicker getting a new birth certificate that you would be trying to get the one back from USCIS.... Just make sure you only send photocopies with your AOS packet.... the originals you keep and take with you to your interview...

You don't get a copy of your medical exam. My CS sent me a copy of my HIV and syphilis results, along with my DS-3025 vaccination record. You do NOT need your medical exam papers. I hope you have that vaccination paper though. That needs to get transferred onto form I-693A - the vaccination supplement form.

As for the birth certificate - never give originals. Always make copies.

If you gave your fiance's BC to USCIS and didn't get it back you'll need to get another copy.

If he was born in Lima this is pretty easy, anyone living in or near Lima can get it and mail it to you. They'll need his name and DOB + $. Takes 1-3 days.

Make sure to get at least two copies (just in case) and verify that they are "para uso en el extrajero" version of the peruvian BC (has an extra watermark and costs extra).

Another tip for later down the road, get your US marriage certificate legalized by the Peruvian consulate and then your SO should get his DNI updated with the new civil status. This is not a requirement for USCIS, but important for "tramites" in Peru (and also it is a new law in Peru that citizens' documents must reflect their civil status).

What about the original set of documents sent to TSC when applying for the petition, the ones sent by the USC fiance? My SO wa wondering the other days if we could ever get those back, as after working so hard on it (he organized a very impressive binder, indeed :blush: ), he became attached to it and would like to save it as a memory of what we have been through to be together. :yes: We do have a copy of the file, true, but he read somewhere that it was possible to ask back the original. Can you please tell me if you know for sure that this is/is not possible? Thanks a lot.

The practical answer to your question is no you cannot get it back... That is why you retain "originals" and send in a copy of your filing (only including the 2 or 3 documentst that are required to be original).

Thanks, fwaguy, it seems reasonable that the documents one submits with an approved petition would remain with the petition, to sustain its approval at any time. But as my SO impressed me with such a romantic request, I cannot help but looking more into this and trying to see if there is ANY way to get the file back. ;)

We did not submit originals, of course. Just would want to put the so called "original" file in a very special place in the house, for our grand children to look at it :P So that he can say "look what I did out of love for your mother" and me "look what the state considers love is made of" :)
