Hello,

 

Im seeking for advice from anyone, any idea will be appreciated.

 

My mom came to visit/take care  my sick dad  America from May/2020, the border custom allowed to stay until Nov 11th, 2020. (6 months)

 

In October, I applied  I539  for her, asking  USCIS allows her to stay until May 2021 because her airline ticket was cancelled, her original country closed until they have vaccine.

 

Until now, the application is still pending. No information from USCIS.

 

Look like she could not come back to her country until the end of 2021. The country closed border even she is a citizen from there!!!

 

My question is that can I modify the desired staying date in an existing I539  I submitted and how? (Until Dec 2021 Instead of May 2021)

 

If not when should I apply another I539, even the 1st I539 has not been approved yet?

 

Her B2 visa expired in March/2020.

 

I tried to call USCIS but never reach any real human!!!

Technically she does not have to go home, just leave the US.

VietNam controls strictly the spread of Covid,  more than 1K positive cases so far.  ~90K being  quarantined.

No one could enter this country except charter flight for citizen, but you have to be like a lottery winner to be in that flight. Even someone registers for 1 year plus agree to pay ticket price 8 times more than usual price.

So no hope!

Consider applying to adjust your mother's status if either of you are a US citizen.

 

 

You got to it before me, and yes you can expect USCIS to know what the deal is and if you state a reason which is obviously false you can expect a refusal.

Not true you can flight even you are elderly and ready to pay high price ticket. Million of Vietnamese people around the world want to back home, but as I said, even you register for months with Embassy, still no help. There are a lot of Vietnamese workers begging government to give them a chance to go home because they are homeless, starving and holding expired visa .

Yes, its just possible for some people on the flight  as  lottery winners.

I'm Vietnamese, so please stop exaggerating.  Millions of Vietnamese are not signing up for repatriation flights.  Tens of thousands, but not millions.  Yes, there's more demand than available seats.  Guest workers in Japan may be homeless, starving, and have expired visas.  Doubt that Vietnamese visitors to the US are homeless or starving.  They came here to visit family who they end up staying with.  Like your mom did.  


Did you state a reason for wanting more time in the US on the I-539?

 

If the I-539 is deny, then your mother is probably never going to get another visitor visa.

What was the reason you stated for wanting more time in the US on the I-539?

Did you come back to VN successfully? Or your family member did? Can you share your experience with me? Did you join some forums waiting for the flight and know how Vietnamese citizen suffering with expired visas in Asian countries?

 

Wanting more time on I 539 because there are no hope for my mom coming back to VN in May/2021.

 

With Covid19 and no commerce airline tickets (Now government just announced no flights again), I don't think she got denied. I'm just confused about  applying another I539 or somehow can modify the existing I539.
