I-130 for Stepchildren

Timeline

I recently filed the I-130’s for both my stephchildren to join my spouse and I here in the US. Previously I filed for my spouse and it required mailing in full packages of documents. This new process was a bit strange just filing the form online and attaching the marriage certs and birth certs. I fee completely deficient with information. 

Can any provide any advice or tips. We have been through this process before with my spouse, but just would like to know if we should prepare for anything out of the ordinary.

There is much less proof required for a child (all you need to do is establish that the (step)parent/child relationship exists) compared to a marriage visa (where you have to prove it is a bona fide relationship). It’s fine!

You need only prove parent/child or stepparent/ child relationship.   Besides what you already provided,  what other evidence is there?

That is what I am inquiring about in my post. If there could possibly be anything else requested? My spouse previously went through the process, the children are now wanting to immigrate after. Is any consideration given to the fact that the primary parents application was approved already?

If you've already provided the documents listed below, then no need for you to worry.

If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child’s natural parent showing that the marriage occurred before the child turned 18 years of age, copies of documents showing that any prior marriages were legally terminated (if applicable), and a copy of the stepchild’s birth certificate.

The instructions are the key to your answer.   If they want more evidence they would ask for it in the instructions.   Your chance of success will be greater if you read carefully,  interpret literally,  and don't overthink.  

 

The requirement is to prove a qualified relationship between the petitioner and the beneficiary.   Period.  It doesn't ask to prove the relationship AND prove a successful prior petition.m ( or anything else for that matter).

I have recently filed for my step children as well.  We did the I130 online and i submitted their bc, passport photo, my husband's bc, our marriage license, my bc, a letter from their now deceased mother giving my husband and his mother physical custody and a copy of her death certificate (they didn't ask for most of that, just wanted to make sure i submitted enough info).  The I130 process took about 8 months to approve (TX center).  We are now at the NVC stage.  It took the cases about 1 week to be DQ'd, now we are patiently waiting for an interview

My stepdad filed i130 for me in December 2019. We were first at Texas center but transferred the case to Potomac. 14 months and still no i130 response. Please keep me updated on your case and how long it takes to get an interview so I can get some insight on how mine will be like :)

Hello, apart from your children's passport photograph did you put your own passport photograph too ?

Hello, apart from children's passport photograph did the USC Petitioner need to attach his or her passport photograph too ?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
