Timeline

Hi everyone I’m looking for any advice or suggestions or tips to help me with my husband’s removal of condition. I submitted his I-751 form in May of 2019 & since September of 2019 it says his case is ready to be scheduled for an interview but have not received any news as to when his interview will be. We have been patiently waiting but now his extension letter is expired & I’m hitting a dead end. I don’t know how to proceed to get his case going so that he can get his interview scheduled . I need your help. Please tell me how to move forward in this...

I think you should apply for citizenship and for expiredextension letter, you can schedule and infopas appointment to get a stamp on his passport in case your husband want to travel.

there are couple things you can try:

1. Make an appointment with USCIS to get a stamp to your husband's passport or a new extension letter, it should keep him in good visa status for a while.
2. Filed N-400 for citizenship which will boost the process of i-751.

SRC (Tx center) is usually super fast on process, not sure how that happen to your husband.

His was a CR1 visa. CR1 Need to have an interview for ROC.

Timeline

Most likely you are waiting for an interview date for your ROC, many USCIS field offices are way backed up due to COVID. The only legal option is to file a Mandamus lawsuit against the USCIS in three months or so.

K1 Visa Arrived USA July 2017

Married August 2017

AOS Approved July 2018

 

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Fingerprints reused May 2021

Combo interview May 16th 2022, in Sacramento, 

Approved June 08, 2022

Oath Ceremony completed June 29th 2022

Try and get an infopass appointment by calling the USCIS number, ask to speak with a tier 2 officer. Get a stamp on his passport. You can ask your senator or congress to help investigate the delay.

If he needs evidence of status, call uscis to request an Infopass appointment. If it's not an emergency e.g. need it for a job or to travel soon, you won't get an appointment because you don't really "need it". For reference, I filed ROC Sept 2018 and I didn't get my interview and approval until December 4 2020. There are many people who are also waiting. Hopefully you get your interview soon but honestly, I just lived my life and didn't worry too much about the time it was taking. 

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:
