I didn't lie, in Kenya we kind of consider cohabitation as marriage,  payment of dowry is enough to be considered marriage.  We do not marry legally, as most of us do customary marriage.  It's hard to divorce on paper if you were not married on paper. Anyway I was married in Kenya but not on paper

It is IMPOOSIBLE to prove you were never married.  That's why a person should NEVER misrepresent that fact on paper.  OP could be facing a lifetime ban.  OP needs to Hire an attorney.

For a marriage which didn't exist?

Hi,I got a question.,,,,when I was making my application for visitor visa back then in Kenya I had indicated was married.and yes I got my visitor visa and came to the states.here met my husband now and we are now legally married.I would like to make application for adjustment of status  to permanent residence /green card.now my question is since the marriage in Kenya was not legal will it be a must to prove the marriage in Kenya ended.must-have divorce papers from  kenya?

Has anyone been in such situation how did you go about it?

Thank for the feed back

You need to consult  a very good immigration attorney on your matter.

If you file for AOS, Immigration is going to want a divorce certificate on the marriage you claimed when your applied  for visitors visa.

Rather it was just customary in your country, you claimed you were married.

Lying right there very well dooms you for any further immigration benefits, and USCIS will see your as a bigamist if you file for AOS

You can lose your visitors visa, and deport you, with slapping you with a ban from entering the US for a long time if not lifetime ban.

Good luck!

I was in the same scenario from Kenya, I had to get a certificate of ni impediment to marriage from Kenya to show that am free to marry, or maybe get a divorce certificate if you want/can

Don’t get a fake divorce certificate - someone on here did that and now they are in even more trouble than lying about being married on a previous application.

The OP has the advantage of being in the US rather than most cases, all?I have seen where the B was refused.

Obviously not a DIY situation, intrigued as to what they will do

Consulates in Countries where this is common is one thing, not sure how often this is seen in the US.

If it was a come we stay and there was no proof in sheria house or kwa chief then just get a certificate of no impediment.
