I think mine took more than 6 months but that was sometime ago.

Milligan Plaintiffs who are NVC. Pre-COVID, cases routinely took six months for NVC to transfer to post.

I just don’t see how that is accurate at all! Even during covid and NVC not really sending cases, mine was transferred to the embassy in 6 months. Approved March and transferred to Sweden in September. What’s he on about? Lol

But cases filed right before covid would still be stuck at NVC? He’s confusing a lot of other people too. A few replied with “don’t you mean 6 weeks” and he said “no, I mean 6 months”. Also someone else replied that the whole K1 timeline pre-covid was 9ish months so how does 6 months at NVC fit into that? He said anyone saying K1s took 9 months before covid has severely miscalculated. I’ve never heard of a K1 case being at NVC for 6 months pre pandemic, maybe a rare few but that’s definitely not the average.

Our K-1 in 2018 took 6 months from mailing the petition to NOA2.  Two months after NOA2 we were married.  The NVC part was like two weeks, as that was the schedule for mailing the batches.  @Greenbaum remembers those days.

Hmm, well I remember the whole process was 14 months. I would need to do some digging to work out where it was stuck at each point.

Ah, okay.   Yes, there has been much fluctuation in processing times over the years.  Right before COVID, processing times for petition approvals were half of what they were our year - like 3-4 months.

I was a 2018 filer as well. Processing time from NOA1 to NOA2, as well as the NVC part was similar to yours.

i haven't seen anyone post that they were in lawsuit and have had an interview here on VJ

Did i miss something?

or were these people already in line for an interview?

anyone know?

I know a couple from Poland they had an interview while embassy is not processing k1 visas, so they had interview just because they were plaintiffs in lawsuit, when I asked how you could get interview scheduled they answered only because they took part in lawsuit , they were given visa without being questioned at all. That's why it is worth trying.

I personally think it's worth it, and I'm happy that we joined and that now our case is moving because of it. ☺️

But with that being said it actually is true that they don't put you ahead of non plaintiffs. But as long as the travel ban is still in place that doesn't really matter one way or the other because the non plaintiffs, like you say, aren't getting interviews right now. If that somehow were to change, though, and the travel ban lifts or a change in procedure happens I do not believe a plaintiff that hasn't yet gotten an interview scheduled would be put ahead of a non plaintiff because then they would be processing all cases. Hope that makes sense.

I just wanted to clear up the part about plaintiffs not being put ahead of non plaintiffs. Plaintiffs simply "keep their place in line" among the visa applicants currently getting interviews.

He means that now during ban plaintiffs are put ahead because a couple from Poland got visa even they were approved after us  so it shows that as they were plaintiffs they had benefits . we also wrote a letter asking interview being scheduled because Belarus isn't in Schengen area and we were rejected, so I can say plaintiff really good ahead non plaintiffs now otherwise this lawsuit would not have had sense.

Thank you everyone for their comments! We've been debating either to join or not for a week now - our case is at NVC but since January only so there is no 'unreasonable delay'. We actually almost paid but than I saw the tweet from Jeff and was a bit confused too :) We decided to join regardless, 2K isn't that much for a chance to be with your loved one. It's just sad we had to go this way.. but oh well if it's the only way!

I forgot to add that we have to go to interview to Poland because in Belarus they don't give immigrant visas

I think you should go for it if you can afford it,if you’ve been following the entire thing since there wasn’t even a lawsuit , you’d know that it’s helped many couples. It’s worth a short and I’ve seen most people that filed already married from the first round. The second round most already have their interviews.

I wouldn’t trust what the state department says because they always contradict. Yes they say that the plaintiffs won’t be given priority but how come the embassies are ONLY scheduling for plaintiffs? They also said k1s will be given high priority when things resume ,that was false. I also suggest you ask this question in a group about k1 visas like on Facebook or something other than here because most people on here seem to dislike the entire visa category.

That is the site i use to see all the visas issued from all embassies

and the ones issued can be from  those who have been in long AP and interviewed before the covid crisis and/or the lawsuit

what i have not seen is anyone here on VJ say "we were in the lawsuit and now have had our interview and visa issued "

Because many people don't care to come here to update their timelines. In Spain, round one plaintiffs (just one) is quarantining in Aruba, going to the US in a couple of days. Second round plaintiffs (like me) got scheduled interviews for mid-late february.

An opinion based just on this website data could be, and is in this case, false.

i am a round 2 plantiff.. The judge granted us late january and within 2 days our case moved from NVC to Embassy and then 2 days later we got our interview for 1 month out in february.

I dont know if Brazil is subject to travel bans but if you are you can join... If you arent then you cant.

But the first round plantiffs all have their interview scheduled and some are already in the US married.. and alot of round two have their interview scheduled the ones that seem to be giving a hard time is manilla and juarez ie - those not subject to travel ban

I had been at NVC before I joined since June 2020
