wife is MIA

Hello All,

 

I hope i can find  some help here.

my Brother met his wife while she was visiting our country ( overseas).

she came back and got married.

went back to the US and filed for a spouse visa, everything was going smooth until they needed a sponsor since she was only working part time..at that time they couldnt find a sponsor and it took a toll on their relation.

she decided to disappear...with no word or notice..she vanished..now 5 years later.. my brother wants to re marry, but he need to divorce the American girl first, she is no where to be found, we found some addresses online,the foreign court keep sending her documents to sign just to finalize the marriage but they get sent back for address in incorrect.. we tried looking her up..facebook..online..nothing.

can you please advise on how to handle this situation?

Hi,

 

Your brother will have to follow the laws on how to divorce based on abandonment in his country.  Nothing can be done in the US since you can't locate his wife.

Correct.  Divorces are obtained where the person filing lives.  Your brother will follow procedures in HIS country that apply to his situation.  If there IS no procedure that fits his situation, he will remain married.
