Nigerians visa ban uplifted

USCIS processes petitions. Back when the ban was in force (before Jan. 20) it focused on US entry and waivers at the visa interview. Thus petitions were still being accepted and approved by USCIS; that is still the case today in regards to petition processing.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

so  i am free to apply for cr1 visa at the moment or do i need to wait until USCIS update their website to noticfy the public that the ban have uplifted because i called  an immigration lawyer today and he told me that right now that i should wait because the USCIS have not give them update on the ban over Nigerians that it will take 45 days from the date it was proclaimed

There has been no ban for USCIS regarding the processing of I-130s for Nigerian spouses .  You have never been prohibited from filing an I-130 and starting the process.  The longer you wait, the longer the queue will be.

That is pure misinformation from the lawyer. The ban was not relevant at all to petition processing by USCIS.

USCIS never stopped accepting and processing petitions for Nigerians. Go ahead and submit your petition.
