I've heard or read somewhere

that the visa withiout permanent residency intent will expire

once the GC application is filed. because the intent is changed.

Is it true?

I have heard that H1b is dual intent one ,so it's OK.

but J1(or F1 ) will expire ?

If it expires I , should quit the current intern job?

I just filed the AOS and checks are cashed out today.

Hope anyone can help me.

4/19/2006 Request FP reschedule by snail mail with original FP notice

4/28/2006 Got FP Final Notice(which says take FP anytime anyday) with original Notice!!

4/29/2006 Took FP at Brooklyn Application Service Center

5/6/2006 I-485,I-765 touched

5/8/2006 I-130,I-765,I-131 touched

5/20/2006 Recieved Interview Notice on July/17/2006 at Garden city.It's comming !!

5/31/2006 AP approved and sent by mail, I-765 touched.It's comming !!

6/1/2006 EAD approved and sent by mail. It's comming !!

6/5/2006 AP arrived ( two I-512L s, one for POE, the other is for me)

6/6/2006 EAD arrived

7/17/2006 Garden City GC interview.. not quite good..

8/2/2006 show approved online

8/2006 Welcome letter arived!!

8/16/2006 GC arrived !!!!

Hi

I was in that case. Your J1 does not expire once you apply for AOS. You can keep on working until the end of your J1. When you apply for AOS, apply for a workpermit as well. If you're lucky you'll get the work permit before the end of your J1 and you can keep on working after the end of your J1. If there is a gap between the end of your J1 and getting the work permit (that's my caes) you are just not allowed to work for a while.

If you have a foreign residency requirement attached to your J1 visa then you can not adjust status. Do not know if you do just bringing it up.

From the AOS instructions.

You are or were a J-1 or J-2 exchange visitor and aresubject to the two-year foreign residence requirement andyou have not complied with or been granted a waiver ofthe requirement;

I had a classmate who was on a J1 visa and married a US citizen and she had to go back to Mexico for two years before she could come back to the US as a perm resident.

That's great! I applyed for I765 and I131 as well

so All I have to do is wishing EAD come within 4 months before my j1 expires.

Fortunately My visa stamp says that

I am NOT subject to 2 year home residency requirement.

but thanks for concern .
