F2B - Trump Proclamation Question

Hello,

I have a few questions about Immigration Proclamation Ban, if I may.

The Visa Bulleting is frozen on 08 JULY 2015 (rest of the world) for F2B since September 2020.

Is this due to Trump's proclamation? 

Has President Biden revoked Trump's ban?

Is there a link where I can read about those presidential decisions? 

When the ban is suspended, will F2B recover the date lost in those last 5 months of Visa Bulletin?

I heard about those executive orders but did not had a chance to learn about them.

Presidential Proclamanation has nothing to do with visa bulletin.

04/15/2015: Passed Interview

05/05/2015: Oath letter was sent

Apparently tomorrow might see an announcement about overturning the ban. 
 

I do actually think that the ban might be the reason the for the slowdown/halt in various family categories in the visa bulletin. There is little point in advancing them at a furious rate when no one can interview at consulates. However, I don’t think there will be “catch up” when the ban is lifted, quite possibly the opposite because embassies will struggle with capacity to meet the backlogs, and they might even have to retrogress some of the categories.

My son is presently living in Brazil, but he is also Canadian citizen.

-Is there a way to find out the backlog of both consulates in Rio de Janeiro, Brazil and in Montreal, Canada? 

- What is the minimum children's age required to be present at the consulate interview?

The consulates stopped interviewing when they closed for Covid around mid-March last year, then the Trump ban started in April. Most consulates have started some interviews for non banned categories, but there will be no way to know the actual backlog until they start all interviews again. Rio is one of the few still closed to all visa interviews. That said, Montreal was notorious for long waits even before Covid. 

There is no minimum age, all applicants for immigrant visa interviews must appear. Minors bring a parent or guardian to accompany then.

If under 14, the CO has discretion. 22 CFR § 42.62(a): "Every alien applying for an immigrant visa, including an alien whose application is executed by another person pursuant to § 42.63(a)(2), shall be required to appear personally before a consular officer for the execution of the application or, if in Taiwan, before a designated officer of the American Institute in Taiwan, except that the personal appearance of any child under the age of 14 may be waived at the officer's discretion."

The backlog in Rio is enormous. The last interviews listed here on VJ happened on March 10. Since then they have only been expediting.

I got my DQ is May and have not gotten an interview letter yet.

Fingers crossed!

What time zone are you in? Tuesday is very far from over in the US. The immigration announcements are scheduled for 5pm EST today. The preliminary indications do not make it seem like the bans are included in the package, but we will see when it happens

But that was the whole point of the Trump ban...slow down or completely switch off the immigration faucet as a whole. Covid 19 provided a legal opportunity to do it, since Congress would never have signed off on what he was proposing.

I am in Eastern time zone. I was just referring to the executive actions Biden is going to sign today. These are 3 and unfortunately rescinding Corona ban is not among themselves. According to CBS news, an admin official says it will be done in future. Again, its indefinite meaning not a concrete one

Hello Hilde,

Thank you for the information about the American Consulate in RJ backlog. I guessed it should be as the consulate site indicate they are not processing immigration since March 2020.

My I-130 petition is expected to be approved sometime between Oct. 2021 and 2022. 

In normal times, before the pandemic,  how quick/slow was the Consulate in RJ in booking immigration interview cases ?

Don't quote me on this... but I think it was around 3 months. It wasn't considered too bad of a timeframe, compared to other embassies (like Canada, who is relentless for much longer waits).

If you want, you can research this in great detail here in VJ. If I have some time the next few days, I can try to do it. If you find the answer before, pls circle back here.
