Conflicting statements form NVC and Dakar US Embassy

Hi all!

I filed my k1 fiancé visa application in February 2020. Got notification that NVC had our application in July 2020. Of course the pandemic slowed things down, but now the US Embassy in Dakar states they are processing ROUTINE visa cases not subject to the proclamation so they should be processing cases like mine. When I contact NVC, they tell me they are waiting for the Embassy to contact them and notify them that they are processing routine cases... And when I contact the Embassy they tell me they are only waiting for NVC to send the application. I am so confused and lost on what to do next. As a healthcare worker, I completely understand the impact of Covid and the pandemic.. but this seems like something else... Should I look for a lawyer? Should I continue waiting in hopes that the new incoming administration will help move things along??

My best to everyone else struggling through this difficulty journey!

Thanks for any answers or words of advice!

You are not alone, there is nothing you can do until they process routine visas again.

That's thing, the Embassy states they have started routine visa processing since November 16, 2020

"Routine" doesn't necessarily apply to all visa categories.  They may be prioritizing visas for immediate relatives, or students etc.

A lawyer cannot do anything about these processing backups.

Quoted from the website

"

As of November 16, 2020, the United States Embassy in Senegal is resuming certain routine immigrant and nonimmigrant visa services, to include: F1, M1, and J1 visa classes not subject to Presidential Proclamation 10052, E, I, O, P , K1 fiancé, certain immigrant visa classes not subject to Presidential Proclamation 10014, and I-131A Lawful Permanent Resident Boarding Foils for lost/stolen/mutilated cards. Interviews for all other visa categories, including B1/B2, remain suspended. The U.S. Embassy in Senegal will continue to provide emergency and mission-critical visa service for urgent humanitarian, medical, and business travel.

I would understand if they just simply weren't processing K1 visas and NVC wasn't sending it for that reason but this doesn't make sense to me.

We have been approved at NVC since April,2020. We get  the same thing almost NVC saying they are waiting on word from the embassy in Dakar so they can send our file. The Embassy in Dakar states they are waiting on the NVC to send it I have tried 4 times with medical documents to expedite and all I hear back is from the NVC stating the embassy will not expedite it. But if I contact the embassy they tell me they are waiting for it to be passed  onto them. Lack of communication between the two. My friend just got her husband here through Dakar and when she set up his appointment she said there was available appointment openings on Tuesdays and Thursdays every week, so I believe it is a problem at NVC stage not communicating with Dakar.

YES! Exactly!!! It's so incredibly frustrating! It's like how is there this break down in communication?? I get the same answers.

Wow, congrats for your friend! What a relief.

Since April!! That's just not right to me!?! I've been approved at NVC since July 2020 so I'm trying to stay patient but it's seems like the most frustrating issue. When the NVC emails me back they attach the link for the embassy "for the most up to date information" .........

I hope you get some movement soon! I'm considering getting a lawyer because this seems like a mistake on one of their parts (NVC or the embassy).

Hello,

I am having the same problem with the Amman Embassy providing conflicting information with NVC. My case has been stuck since September 2020 and Amman is not subject to any bans. I have decided to move forward with a Mandamus case because it seems like the only way to get an interview

Have you tried contacting one of your State representatives? I finally had movement about 3 weeks ago and NVC finally released my case to the Embassy. Now waiting at the embassy for an earlier interview appointment.

I was emailing and calling and emailing constantly to the NVC and the Embassy...
