Wife needs ITIN to file taxes jointly, needs to file taxes jointly to apply for her ITIN, and can't file unless she already has SSN or ITIN!

Hey guys -

 

Frustrating situation described in title.

My wife and I will go to an in-person appointment to apply for her ITIN in a couple of weeks. However, we need to bring our 1040 form ready to file WITH her ITIN application. To complete the 1040 form, we need her ITIN! As you can tell, this situation is very aggravating.

 

Putting all 0's or all one number for her SSN/ITIN is rejected by all the tax software I've tried. I put my own SSN but I have a feeling this won't fly with the IRS.

 

What should I put in lieu of her SSN/ITIN on the 1040? Thanks!

That's like your 3rd post about it and you already got answers for it.

 

You know you will have to paper file the return, right? Download the 1040 from the IRS website and fill it out by yourself based on the one the tax software generates. You also don't have to use a tax software at all.

 

It also doesn't matter what number you put on the 1040 in the tax software because you're not e-filing. You will have to download the 1040 it generates BEFORE submitting it, so you can change the number to whatever number (or no number) you want in there.

Or, just put in a fake SSN for your wife in the tax software, print out a paper copy, then use white-out to remove the fake number.  That works.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Appointment with who?   

IRS offices no longer help fill out tax returns /  they stopped that back in the early 2000's

and if they did they would just fill out the W7 and mail in all supporting documents to the main IRS office in Columbus OHIO for Ohio residents

 

I ask as you apply for the IRS for the ITIN along with the 1040 form  leave the space blank for her SS # 

and i suggest you file paper return by mail and not online as IRS will delay your return by asking for you to send an original marriage certificate and the spouse's ID

 

the ITIN will be issued when they process your taxes not before

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you're including a W-7 with the 1040, to apply for an ITIN, everything has to be filed by paper.  When we did this in 2019, we just printed the forms, schedules, and attachments as needed and filled them out by hand.  For my husband who was still in Brazil at the time, I wrote "ITIN applied for" in the spaces for SSN or ITIN.  We got his W-7 certified by an IRS acceptance agent in London (accountant) when we were there on vacation together, so he didn't have to mail his passport as he needed it for travel.  Good luck!
