Hello everyone.

Hope everyone is doing well in these challanging times.

I have moved to the USA Last january, on a K1 visa, and married, my now wife ,end of February.

With all that has been happening last year we had some difficulty finishing up my AOS

I do not have a SSN or ITIN. And it is tax nearing tax season.

My question is, how does my wife file her Taxes this year, since she is no longer single on her documents.

I know she has to write down that she is married, but does she fill out the form as filling jointly, or seperatly,?

Am i considered her dependant?

I am grateful for any further information that i recieve.

Stay safe everyone and thank you.(i apologize for any typos)

Use W7 form and file jointly manually in paper format to irs with your tax return/w2’s etc they’ll issue her a ITIN as part of your joint return...

She can file married filing jointly and you file for ITIN.  You submit it all to the address specified in the ITIN instructions.  Or make an appointment at the nearest IRS field office that processes ITIN.

There is a tax forum dedicated to these type of issues.   Visit and read.

You are her spouse and NOT her dependant

Is there anyone who could lend you some money to file your AOS?  At least, you could then get your EAD in a few months... Please try to file as soon as possible.
