Work permit renewal (removed)

hi

i filed my i-485 in 2019 november with i-765, got my firgerprints taken in 2019 december 18 (big hopes that i'll get my green card pretty fast), got my work permit on february 27, since then there is a complete silence. i had to file for work permit renewal this january i did it with expedite request, in addition with the text message / email notification request, but i still haven't gotten a single text message or email from them.

should i file it again?

.gov sites say that the permit is automatically extended by 180 days if you're in an eligible category (i am) and if you file the renewal request in time (i did, however no evidence other than a fedex tracking number saying delivered on the 9th of january)

i didn't pay for it because the fee calculator .gov website said i don't have to. i'm pretty sure i filed everything that was needed but even if i missed something they simply should either deny or inform me through the i-797 right?

i'm confused, i have a great job can't afford to lose it.

You have to send a copy of your AOS NOA 1 with the package. If you didn't do it, then your package is gonna be returned for no payment.

 

You waited too long to renew it. You should've file for it at 180 days before the expiration date. 

 

To be extended for 180 days you need the NOA 1 for the renewal. If your package is returned and the EAD expires before they receive a new one, you will most likely lose your job.

I think the case number should do the trick.

Also sent a screenshot of the https://egov.uscis.gov/casestatus/mycasestatus.do website with my case number saying fingerprints were taken on Dec. 18. 2019.

 

"you should not file for a renewal EAD more than 180 days before your original EAD expires" it does not say file it exactly 180 days before it expires. I'm not expecting to get the card by the expiration date of the current because it does not matter (automatic extention applies to me). I only want to know that they are on it since i have nothing else to submit that I already have submitted.

 

I believe my request of email/text notification should inform me if my application is denied.

I'm (c)(9), I applied before my old one expired, and my eligibility category is the same as the old one.

If they'd send an acknowledgement that they actually received my application not just threw it in the trash bin because they had a bad day, I'm good to go.

  • (CHECK) A copy of your last EAD (if applicable)

  • (NOT APPLICABLE) Form G-28 (if you are represented by an attorney or accredited representative)
  • (NOT APPLICABLE) If you were not previously issued an EAD, you must submit a copy of a government-issued identity documen

Adjustment Applicant Under Section 245 (c)(9) (unless you are filing the I-765 concurrently with Form I-485)

Did you provide the following?

  • (SENT THE I-485 CASE NUMBER) Evidence of a pending I-485 under INA 245 (for example, a copy of your Form I-485 receipt notice or other evidence)

Case number is not enough. Besides having a pending AOS, you must have paid the full fee for it. So they need to see proof they you paid the full fee for the AOS form, and that's only possible with the NOA1.

 

If you can file for renewal at 180 days. DO IT. If you get MSC case numbers, your EAD will take more than 8 months to get approved, that's more than what the extension letter provides you.

 

You can send another one, but you might end up with duplicate applications, and that might not be good.

 

One last question, did you send the renewal form to the Chicago Lockbox?

Its not a requirement to file exactly 180 days before it expires... I dont know where you get that information from. Once you receive the letter that the card is coming the old one plus paper is valid for work authorization until the new card arrive. The ONLY reason they say you can extend 180 d before is to account for the time it actually takes for the paperwork to be processed

So if i don't have that piece of printed paper (containing the exact same case number that i sent them the screenshot of) for any reasons my whole procedure is gone you're staying?

No. If they don't accept your screenshot and return your package, you're gonna have to pay the fee if you don't have your NOA 1.

 

As a reminder: always save all immigration related paperwork.

 by definition it is i-797 request for evidence.

it is very blurry if when i should simply re submit or what is there to do in case of a b or c. 4 or 500 bucks is not a big deal. what is a big deal is that they have strict deadlines yet they're slow af. i do not care if they reject my application (no reason thoug) i only 'demand' that they send me a status update after 27 days. like "received" but complete silence in this category is unacceptable.

i can't edit. i meant by definition they shouldn't simply automatically deny my application but they should request for evidence. which is impossible since i can't find the document. i understand the principal of keeping things but they don't say i have to keep the document which's purpose is "USCIS uses numerous types of Form I-797 to communicate with applicants/petitioners or convey an immigration benefit. Form I-797 is NOT a form you can fill out." technically they remind the applicants not once that the "document" is a worthlesss good for nothing printed piece of paper so no one should be surprised if they throw it away (which i didn't it simply got lost. and that should NOT be an issue in 2021 when everything is digital)

 

i got lost here. all i'm saying is that they did not give me a feedback of any kind in 3 weeks and that i will resubmit with like 50pt fonts in the front "RESUBMISSION - URGENT" because it is. if they want the applicants to apply 70-100-150-180 days before the document expires they should say so. by the rule one could apply for renewal 5 days before the expiration date.

typical case of "don't blame the player blame the game"

USCIS can't accept an application without payment or a fee waiver document, which I'm this case is the NOA 1. So yes, they can and they will deny if you don't send it.

 

It's your job to read all the instructions and keep evidence of everything you submit and receive related to immigration. And you will find anywhere that your NOA 1 is your only proof that you have a pending AOS and serve as authorization for you to stay in the country. Don't expect USCIS to babysit you and teach you what to do.

 

During the pandemic, it's taking anywhere from 4 to 8 weeks to receive a NOA, but if your package was rejected, add another 4 weeks for the package to return to you. And that's assuming you sent the package to the correct lockbox (chicago). You should also have a tracking number, if it says delivered, that's proof enough that they received it.

 

It was your choice to delay the renewal application when you could've sent it months ago, so now deal with it.

So my other question is if there's a fee. Forums etc say yes, but the website https://www.uscis.gov/feecalculator says $0.

 

The rejection letter says this, but it looks like a standard copy paste. "The payment amount is incorrect, or has not been provided" Does this mean that the I-797 with "Total amount received: $1225" will provide the evidence that it's been paid?
