My partner and I have been together for a few months, what started out as a casual fling turned into a relationship(idek the date we became official just the date we met). We want to plan for what a future together could look like im Native us citizen graduating university in the states and plan to graduate with a job or have a job by September and in the next two years making around $40k. Is this enough to qualify for k1/cr1 visa? I’d prefer to do k1 and AOS but I want to understand the difference of costs.
Also which visa option works best for partner who may also want to pursue studies in the states? He never finished high school due to lack of funds hoping to finish and wants a university degree buy it may be hard to get into us schools with language barrier.

I don’t think the F-1 visa is an option that makes sense in your case. For starters, it requires a non-immigrant intent and strong social and economic ties to the home country. They want to see that he returns. In your case, he has an intention to immigrate. Secondly, if he wants a university degree, then the minimum requirement is to have a high school diploma. Usually, universities require TOEFL exams for English proficiency and you have to score a certain amount.

 

It also sounds that cost is a big factor in your decision. In either K-1 or CR-1, the embassy stresses the importance of current income, not projected income. Even if your tax returns aren’t enough for previous year(s), you may qualify based on current income. That really depends on the consulate and which country it’s in. You can always get a joint sponsor just to be safe.

 

Cost wise:

K-1 with AOS: approximate cost $2,025 not including travel expenses, medics exam etc

CR-1: $1200 (again not including travel, medical etc).

 

keep in mind that if you choose K-1 option, your significant other can’t work/travel until he gets EAD/AP. So if working and traveling immediately is a deal breaker, then go for CR-1.
