Don't file too early: https://www.nytimes.com/2021/01/22/your-money/irs-tax-season.html "the agency has pushed back the start of filing to Feb. 12 for returns for the tax year 2020. The shift was needed, the I.R.S. said, to allow the agency to update and test its systems to reflect late-year tax changes approved by Congress, including a second round of economic stimulus payments."

I usually file late so no worries there!

My spouse is still overseas. I am working on the petition right now. It's tax time! I applied for an ITIN for her but I haven't heard back from the IRS yet. It has been about 2 months. Can I file married filing jointly and leave the SS field blank or do I not file married filing jointly? If I do the latter how do I explain that to USCIS?

Thanks.

How did you apply for ITIN 2 months ago in 2020?

the only time you can apply for ITIN is when you do your 2020 taxes in 2021  / its part of the tax returns

That is not true. I tried to apply for an ITIN 5 months ago and they rejected it because I did not file it with a tax return. You must File tax's with the ITIN in order to get an ITIN number.

When To Apply

First-time ITIN applications.

If you’re applying for a new ITIN, complete and attach Form W-7 to your tax return when you file the tax return for which the ITIN is needed.

Just with regards to the printing out the return and then writing NRA, and paper filing. I had to file for a different obscure situation where I had to write in something else that is rare to do, and that was also how I had to do it for that tax year, as the online individual tax preparation software did not cover it. In fact doing it that way that was the advice given on how to do it on the turbotax forums.

I filed by mail 11 months ago (2019 Taxes) for ITIN for wife and daughter, still have not got the numbers for them.

Filed married Joint, had to mail them in because of W-7.

That is the way H & R Block did it for me.

Still have not got my refund also.

In the line for SS number they put "Applied for"

Is the daughter your child or does she have a different father? If it is your child you cannot file for an ITIN. Did you get the documents back at least? If not there may be some problem. I received the documents back within a few weeks and then the return was mailed a few weeks after that. I do my own taxes and for mine I left the SSN blank.

What others have said is correct. You send it in with your taxes. That is the only way that they will accept it. I use TurboTax which requires me to put in a number. I saved to PDF then edited it to take the numbers out. You can also use white out. The SSN for my wife was sent in blank. They mailed back her passport along with her ITIN and a few weeks later I received our refund. The hard part was that they sent the check payable to both of us and I can't deposit it in my bank because I cannot add her to the account. 1 year later the check expired and I had to request a new one. I have that now and she will be here soon so I can finally add her to my account and deposit it. This was for 2018. 2019 I filed with direct deposit.

I had a similar but non IRS joint check.  I endorsed it, had my wife endorse it.  Deposited it into my personal account with my banks mobile deposit app.  No person ever questioned it.  Case closed.

There are other ways to get get it but for most this is the best way.
