ITIN

My spouse is still overseas. I am working on the petition right now. It's tax time! I applied for an ITIN for her but I haven't heard back from the IRS yet. It has been about 2 months. Can I file married filing jointly and leave the SS field blank or do I not file married filing jointly? If I do the latter how do I explain that to USCIS?

No.   You cannot file jointly unless he has either a SSN or an ITIN.

If you file Married-Filing Separately, you hand-write "NRA" in the spouse SSN area, then mail the return to the IRS.

"NRA" means Non-Resident Alien.

As I said, you have to hand-print "NRA" on the paper form.....then mail it to the IRS.    You can:

1.  put a fake number in the box,

2.  print out the form,

3.  erase the fake number with white-out,

4.  then hand-print "NRA"...

No issues.  You can even file separately now, then amend to a joint return later if you want.

I filed by mail 11 months ago (2019 Taxes) for ITIN for wife and daughter, still have not got the numbers for them.

Filed married Joint, had to mail them in because of W-7.

That is the way H & R Block did it for me.

Still have not got my refund also.

In the line for SS number they put "Applied for"
