FB-4 CATEGORY DQ HOLDER TO CR1

Hi there,

 

Previously I was a F4 DQ applicant, I mean I still am, I received DOCUMENT QUALIFIED email along with my family members as at 25th November 2020. It was all fine until 11th January 2021 when I got married with a US citizen. Now I am afraid that I should let the US embassy or NVC know that I got married as I am already disqualified to immigrate with my family through F4 visa category where my mother is the primary applicant and my uncle is the petitioner. Can anyone please guide me through what should be my next step before my spouse file an application for a CR1 visa category. Thank You.

Hi.

 

Your next step will be to withdraw your DS-260 since you no longer qualify as a derivative.


Your spouse can file an I-130 for you.

 

Both steps can be done at the same time.  You do not need to have your DS-260 withdrawn from your mother's F4 case before your spouse can file an I-130 for you.

Hello thanks for your response, but I wanted to be sure first that if she files an I-130 directly then my previous application gets cancelled? I am actually very confused in this matter and also unable to consult with any expert, Hopefully I will get my info through you guys. Looking forward thanks anyway.

It doesn’t get canceled automatically, you need to inform them to do so. If it doesn’t it’s no big deal, someone will figure it out eventually or your part of the F4 petition will just die. People are allowed to have more than one type of petition in the system.

The I-130 your spouse files for you has nothing to do with the DS-260 you filed as a derivative beneficiary in the F4 case.  

There's nothing to be confused about.  It is very simple. Two different cases.  Two different actions needs to be taken.  One has nothing to do with the other.  Completely separate things.

 

Your spouse files an I-130 for you to start the immigration process.

 

You withdraw the DS-260 you file because you no longer qualify as a derivative beneficiary.   Inform the NVC if the case is still there.  Or inform the US Embassy when your parent goes for their interview.
