You dont file for the visa, you brother-in-law does at the consulate, US Citizen, and USCIS is not involved in this.

You may provide brother-in-law a affidavit of support, and an letter of invitation.

Bother-in-law may have to demonstrate strung ties and reason to return home to the consular officer.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

why an affidavit he is just coming for a visit? When I went to his country they didnt ask them if they could support me. Everything is so much trouble here.

Some times they may want one, sometimes the don't, it is up to the consular officer to determine.

It is not compulsory to provide an affidavit of support. I believe what YuAndDan ment is that you may provide one along with a letter of invitation. Your brother-in-law has apply for a tourist visa from the consulate where he resides.

What happened to the job in the Cyber Cafe.

Money can be transferred, does not prove ties. Of use in showing how he will pay for his visit.

Land can be sold and the proceeds moved.

What does he have that shows that he must return?

He still works in the cafe but he doesnt make much money. I dont know what ties he needs. If its not money or land then he just has his family. He just needs a break to get away from the boredom and I think he will have a good time if he visits for awhile. This country(morocco) is so bad. There are no jobs. I just feel everybody should be able to come here easily b/c its not their fault they were born in these awful countries with no opportumity.

World Population: 6,602,224,175

Could get quite crowded.

You listed a number of reasons why a reasonable person would think he may forget to go home.

But none why he would.

There are many countries much nearer, where a vacation would be much more affordable. No idea what the airfare is, but I doubt it would be cheap.

If he got a student visa denied 6 months ago, chances are quite high that he'll get denied on the tourist visa also. Besides the house, it doesn't seem to show he has strong ties.

I don't understand your comment about letting everyone in from those "awful" countries? So their overpopulation problem, and lack of jobs problem should be moved to the US? If the whole world got up and ran from their problems, what would we have?

OP said land, not a house.

he talks to his brother every day they are very close so he wants him to visit and get away from some problems there. His whole family lives in Morocco my husband is the only person to visit for vacation. I would love to show him america. I think he would love it here.

He would b/c he may ruin his chances in the future if his family wanted to come. His brother is here and he wouldnt do anything to put him in harms way by not returning. I think just the fact that his brother is here as a perminant resident that would be enough to make him go back.
