Confused with 10yr. GC

Hi,

I looked at guidlines on this webpage. I have a two year GC and I have to start gathering stuff for my 10yr. GC. Here are my questions:

- On the webpage for Service Centers it shows which form should be filed where. I looked at all the forms and it does not say anything about I-751 for Nebraska Service Center. Where Do I mail my paperwork??? I live in Colorado.

- This guidline says something about renewing the GC before the second annyversary. Well, do you think it's the date on my two yr. GC? It shows Feb. 7th 2006. So I should file for a 10yr. GC latest on Nov. 7th. (-90 days) correct?

- This year my husband and I went on vacation oversees. When we came back the police officer at the POE asked me how long we were gone, and he stamped in my passport something and wrote in three weeks. When I mail my paperwork, do I have to add those 3 weeks, meaning I would have to send out the package end of November?

- Let's say my application is in process and my two yr. GC expires. The Service center needs longer than three months. Do I fall out of status? What do I have to do, in case my application needs longer than three months?

I am not sure where you mail the application. Dont worry about the 3 weeks you were out of the country. Your are correct about when to file, within 90 days prior to the expiration of your greencard. After you mail in your I-751, you will receive a Noa1 and it will say something to the effect that the Noa extends the expiration of the conditional greencard for one year while the removal of conditions is pending.

Service center that covers the area that you live in.

Nebraska is where you send it.

within 90 days of second anniversary of the conditional card. Note Jan and Dec are 31 day months, so earlyist that you could send is NOV 9th. Make it the middle of November to mail package.

You dont add any time for time out of country.

NO :no: the NOA1 letter for the I-751 extends the green-card for a nother year.
Mailing the Packet & What to do While You Wait

The I-751 form and accompanying documents are mailed to the USCIS Service Center that serves your geographical area. (Use certified mail or priority mail with delivery confirmation, and write "Attention: I-751 petition to remove conditions of status" on the envelope under the address.) You must mail the package to the address as directed (for the type of form) by the USCIS Service Center you are filing at. You will receive a notice of receipt for the form stating that "Your alien card is extended one year - employment and travel authorized". Keep the receipt with your green card. If by some chance you are not approved within a year you will want to make an InfoPass appointment to go to your Local Office to request an I-551 stamp in your passport. This does happen as it sometimes it takes over a year to be approved. After your NOA extension expires, this is your only evidence of legal status which you are required to have, by law.

I'm not sure what you mean by the word "latest", but if you mean that's the deadline, you've misunderstood.

The LAST date you can file an I-751 is the expiration date that's printed on your 2-year greencard.

The EARLIEST date you can file an I-751 is 90 days before the expiration date that's printed on your 2-year greencard.

You can file anytime between those two dates with no problems. If you try to file earlier, they'll reject your filing. If you try to file later, you'd better have a very good explanation why you filed late, because they are free to reject it for being filed too late!

Most people recommend filing nearly as early as possible, but you don't have to hit the date exactly. A week or two after the window opens is fine.
