Hi everyone

 

Trust you are all well.

 

I have a question regarding expediting a k1 visa at NVC stage. Our case is stuck at NVC for a long time like most people and I have a 10 year old son who is not my fiances child, however he will be travelling with me on a k2 visa once we have been issued our visas.

 

The thing is, in order for me to permanently remove my son from my country we had to endure a very expensive high court battle that was extremely lengthy (over a year) because his father refused to give his consent. We filed the order prior to Covid (Oct 2019)and said that we plan to permanently leave my country by June 2021 not knowing that Covid was on the way. The court ruled in our favour 3 months ago however should this visa process drag on for a lengthy period of time which we anticipate it will his father can file a motion at the court to have the order revoked.

 

Is there the slightest chance we could be granted an expedite.

You need to request and receive an approved expedite request from your consulate, not NVC.

K1's cannot be expedited at NVC.  They are by default expedited because the NVC does not "process" the K1.  They just assign it a case number and send it to the appropriate embassy, as long as that embassy is open and is processing K1's.

 

You need to contact your embassy.  If they approve your expedite, they will tell the NVC to send the K1.

You want to expedite for the purpose of preventing your child's father from possibly using completely legal channels to remain in his kid's life?   Can't see that happening.
