I need to file an I-864 for my wife to the National Visa Center. I have 2 questions the first do I list Gross or Net income on the form. Second about the number of house hold members. I know I count her as part of the household but dont know how to handle the children. I am divorced live alone and pay child support only for 2 kinds one almost 18 in 5 months and one 15. I married a woman from Belarus and she has 2 children One 18 and one 25. We married after the youngest turned 18. We married in September of last year. I need to get this back to them as quick as possible. If you could give me some guidence that would be greatly appreciated. My name is Chase and I live in Texas. Thanks in advance for any help you can offer.

so they are sending out a letter. 2-09-07 Waiting for letter....

Got letter said they hadnt received our DS-230. Called the NVC said they had received it disregard letter....2-15-07

NVC has completed the case, 03-09-07 off to GUZ!!!

CR-1 mailed to GUZ 03-14-07

June 8th found out interview is July 9th!!!!!!! Waiting for P-4

P-4 arrived on June 16th at my wifes apartment.

Med check done on June 20th have to go back for results and Vacinations.....

Interview July 9th, PASSED!!!!!

wife flies to San Fransisco July 26th, 20 minutes to clear cutoms..

July 30 applies for SS card

Hello, Chase. You list gross income. As for the household size, you list both your own children as you pay child support for them right now even though it may end soon for one of them. About your wife's children - where are they now and if they're not in the US, will they be immigrating with your wife? Her children will only be included in the household size if they will be immigrating with her or if they are already in the US and you and your wife could claim them as dependents for tax return purposes. Does that make sense?

Pretty close but the ability to claim them for tax return purposes has nothing to do with whether they are included in the household. If they are immigrating, you count them.

So I understand that I have to enter my 2 kids and if one of her son's wants to come within a year or so I also have to enter him even though he is now 18 and turned 18 before we were married. Thanks for the help with this. Chase

Sorry I also wanted to ask for the sone that wishes to come perhaps within a year will I file an I-129F form or an I-130. I never knew there would be so many documents. I try to keep them clear and in the right order. Again Thanks for your input. Chase

I-864 asks for income in two ways - current and past as reported to IRS. For current income take your base pay from your most recent pay statement and express it as an annualized figure. For past use Line 22 on the form 1040 (unless perhaps you've had foreign-earned income excluded).

You do not show your wife's children as household members on the I-864. Do you pay the ex-wife alimony?

If any of your wife's sons will want to join her in the future she will have to petition for them using form I-130. You cannot petition for them, they are not your stepchildren for immigration purposes.

No the son will not be immigrating at the same time for he was not included on the first application. I thought that I could not petition for him since he turned 18 before we married and that only is mother could do that. I thank you for your advice. I will try and finish the form tonight. I will not only the children that I pay child supprt for and use my gross amt on the income questions. Be well Yodrak

Sounds like you have things under control now, but I'm wondering what you mean by "he was not included on the first application".

I do hope that you listed both of your wife's children (and yourself) at item C.17, where you are instructed to list the benficiary's spouse and all of their children. This does not have anything to do with whether or not those children (or you) will also apply for a visa.

Yes I listed both on the origional application but did not show them to be immigrating. I did list all that I knew to list. Sorry for the late message I have been out today. I will file the I-864 with gross income for last year. I think I have finally figured out what is required for the household. My support ends this month for one of my kids so will show 1 in the dependents. Thanks so much for your help and guidence and I will let you know how things go. Take care and always be safe. Chase
