Um, NO, it is NOT, when filing the I-130.  It is needed LATER at the NVC stage.

Hi Everyone,

I got my permanent resident through my previous marriage and divorced on 2018. I got married again this year and applying for my spouse I-130. On I-130 Form, it asks my current 'marital status'. What do I put divorced or married? I also have my N-400 pending (Applied under 5 years rule), do you guys think that will impact my new I-130 application? It also asks me how many times you have been married, so that would be 2 right? Any divorcee out here has similar experience?

Hi VJ members,

I'm filing I-130 for my spouse that is abroad. On Beneficiary's current marital status, I should put 'Married' right since she married to me?  And on 'how many times has your beneficiary been married' , I should put 1 correct since she hasn't been married before. Just want to confirm.

You put “married” and the number of marriages including the current one. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Hello Team,

On the 'Additional Family' part where it asks for Beneficiary's family, Does my spouse need to put my name (petitioner) since I'm the spouse. There is also another section 'Current Spouse' Where I put my name since I'm the current spouse. Just seems repetitive, so wanted to confirm with you guys.

I have a passport size 2*2 photo, Does anyone know if I can just use the Scanner App and upload it as an pdf? Any Since my spouse is from another country, their passport size picture is different size, How do you guys recommend to adjust that.

Yes you can scan.

 

Reread the instructions.   Photo of spouse not needed if they are outside the USA.

it says you are removing conditions,  so if the spouse is here in the US,  go to one of the places like Walgreens and do the 2x2" passport photo

Okay thanks Payxibka, yes my spouse is abroad, sorry I should have read the instructions more carefully. Okay so just for me then.
