Case still in the US Embassy in Spain with no appointment for interview

Hello everyone! Wishing a happy 2021.

 

I am from Spain and my future husband from the USA. My case has been ready to schedule an appointment for the interview since last February. However, the US Embassy in Spain claims that there is still a travel ban, according to the presidential proclamation 9993 and they can not process k-1 visas yet. I have been waiting for a year, no moving forward with the process and it seems like it does not get to the end of these restrictions. 

 

Is someone here in the same situation? Does someone know when the travel ban will be lifted? As far as I have been checking, Trump signed a proclamation for lifting it on January 26th but Biden intends to revoke it... The whole situation is so frustrating. We do not know what to do...

 

Options? Is it possible to actually move to the states through a non-europeans (Schengen area country) and apply for spousal visa? I appreciate any kind of help and ideas...

That is the current situation.

 

There's still no new info, but hopefully DOS ends it's unlawful "No Visa Policy." That policy is unlawful because the proclamations are explicitly about entry to the US, per the law.

 

Consular posts can easily annotate visas with info stating whether or not the traveler is subject to the relevant COVID proclamation:

Which I don't understand is: if there is a travel ban from the Schengen zone still effective, why the US Embassy does not give the option to K1 visa applicants to set up an appointment and get to the US though another country with no restrictions? Stay first there for 15 days in quarantine... I don't know but this is really confusing...

 

We should wait as we have been doing patiently, I guess...

I would assume every embassy is backed up. To give them more of a workload would just make the process longer for others from that actual country. I also don’t think the US is in a rush to bring people to this country as covid is pretty much out of hand here. Not everyone is able to up and travel to another country for an interview and what if it’s in another language you can’t speak? Clearly you speak English so that wouldn’t apply to you but not everyone does. I hear your frustration and you have been waiting awhile. 
 

You can always get married and apply for a spousal visa but in my opinion that would REALLY delay your arrival- probably close to 1.5 years. Personally I’d stick to where you are at and do a lot of FaceTime 🙂 good luck

Hello Ana, you should tell your Fiance to Call or email the US Embassy in Spain and explain the situation, in my opinion the Travel Ban is not an excuse you can travel to another country and them enter to the USA, have him email the embassy requesting an appointment for you

Yup. It looks like the current Administration wants to keep the unlawful "No Visa Policy" as long as they can. The lawyers for the Plaintiffs say they'll try to make the judge's order a wider/universal relief: https://www.facebook.com/kuckimmigration/videos/the-siskindjosephhallkuck-update-on-pending-litigation/250071949899560/ (Start at 7:06) But the government lawyers have said they'll fight that motion:

IMO, odds are that the Plaintiff lawyers would win on that motion.
