I didn’t file 2017 and 2018 taxes until June of last year, and ever since I’ve been waiting for IRS to process my taxes, and I’ve called them several times. They asked me to wait. And it’s taking longer now because of COVID-19. I’ll be filing n400 soon and I was wondering how this is going to affect my case. That is, should I put Yes or No for the “have you ever not filed tax when required to”. I’m not owing taxes and I’m actually waiting on a refund from them. Also, I lost my passport but have a police report. How will this affect me? I also don’t have a copy of the bio page.

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

You have to say yes,   as when filing for an extension (form 4868) you only have 6 months pass the time for filing the taxes

you went way beyond the time limit so "you did not file when required to"

so "have you ever not filed when required to?"    yes

Thank you for your response. But I was technically not required to because my income was low—IRS told me I did not have to file

if your income is at or below the standard deduction, hen you don't have to file 

 but why wouldn't you file  on time to get that refund you say you are due?

afterall,  that refund doesn't earn interest for you

The question does not say “when required to”. It just says: 


“Have you EVER not filed a federal, state or local tax return since you became a lawful permanent resident?”

 

 

So the answer is “yes”.

And THEN you can say “not required to file because income too low” when it asks for an explanation.
