I appreciate your advice...I didn't know before sending my application that the process take this long  just to issue NOA1 but my mistake, I should have gone with the online filling the first place...But is okay, I will be patient for another week or two while working on the online application to be be ready incase if I ever have to use it...All i have to do is canceled my money order and click submit on USCIS website and is done.

And then,Wheneve the lockbox realize they can't cash the money order ,they can send back the whole document back

Don’t do that, they will see the same applicant with two processes and then they get messed up. I read that happening.

I know that you want it, and you want it now. But dealing with USCIS is a big waiting game. Learn a new skill/hobby while you wait, otherwise you’ll drive yourself nuts.

Let’s say for a second that you filed a lawsuit, what do you think the judge will do?
Make USCIS act on your case? Lol.

I’m sure the lawyer will be happy $$

Exactly. I’ve been waiting for EAD since September 2019 when the “Normal processing times” are 3-7 months.

Hey everyone, I have now tried several avenues. Their customer service, the ombudsman and my congressman to no avail. I've now talked with an attorney and suing the Government is quite expensive. I'll be talking with a second later today as well. It's become quite evident to me after 3 months of waiting for the NOA1, they are simply not working. There is no real effort and the incompetence is mind boggling. I'm considering organizing a legal effort to sue USCIS over this. I'd like to gauge support and see how many here would be interested in this to know if it's feasible. The more people represented in one lawsuit the better, not to mention it's much easier on the wallet for all of us. Let me know your thoughts. Thanks

I m waiting for interview from almost 8 months still embassy is closed case stuck in NvC. What are you talking about

I’ve been waiting nearly 2 5 years and still don’t know when I’ll get my GC interview. You’re going to have to get comfortable being uncomfortable. One thing I’ve learned is that the seasoned contributors on this forum are rarely wrong. Take their advice.

EAD that long? Yours is something else. I hope you filed correctly and chose the correct EAD category

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I did everything listed in the VJ forums and did everything that USCIS required. I filed the EAD petition as part of the AOS. I finished the biometrics in October 2019. What’s worse is that USCIS hasn’t even responded to my outside normal processing times request, expedited request, and ombudsman inquiry. So even if I filed incorrectly, I haven’t received anything notifying me about it. I have no way to find out.

In @oscar12's case the canceled money order would result in rejection of the paper filed I-130. Thus there wouldn't be 2 pending cases.

Online filing results in way faster NOA1.

Not for I-130 petition for consular processing. A beneficiary can have multiple I-130s even if by the same petitioner.

Even the I-130 approval notice states: "The approval of this visa petition does not in itself grant any immigration status and does not guarantee that the alien beneficiary will subsequently be found to be eligible for a visa, for admission to the United States, or for an extension, change, or adjustment of status."

I have read cases where they didnt cancel the first application in time, and then the applicant ends up with two I-130s for the same case for no reason other than just being in a hurry. USCIS’s system is messed up as is, I just wouldn’t mess too much with it. As I said before, OP should use this time to learn a skill, such as meditate. You learn a skill, and you avoid becoming nuts while you let USCIS do their work. Win-win.

You have only filed a K-1 since October 27.  If you are so impatient, move to Ukraine and live happily ever after there.  Seems your expectation on how fast things should progress is not realistic at all given we are in a worldwide pandemic..

Pandemic? Since February 2020, I’ve flown to and spent time in Egypt, Romania, LA, Philadelphia, New Hampshire, and Seattle. Not once have I seen any evidence of a true pandemic. Sure, I’ve seen lots of arguing scientists and dubious reporting and political fear-mongering and government decrees and obediently nodding citizens, and rights being yanked from all of us. I have not, however, seen any evidence of a true “pandemic”.
