Hi,

 

I'll be soon submitting for I-130 to bring my mom to the US. I'm a naturalized citizen. I asked for advice to a paralegal and some of her recommendations kind of surprised me. I wanted to know your opinion. 

1. She told me I should apply via mail (paper) as the online method is not very reliable (?)

2. I'm submitting a copy of my birth certificate showing both my mom's and my dad's names. The name on the birth certificate matches exactly the name on her passport as she never changed her name after marriage. The paralegal said that even though I don't want to petition for my dad I should include a copy of their marriage certificate and their divorce decree anyway (they are divorced now) to show  "I was born to a married couple"? I guess she wants to show that the people who appear on the birth certificate where also married at one point. I do *not* intend to bring my father.

3. When I submit a copy of my passport should I include all pages or only the first page? Does the same apply to her passport?

 

Besides naturalization certificate and/or US passport for petitioner (me) and my birth certificate proving she's my mother, is there anything else? She has never been in immigration proceedings and she has a super clean record.

1.  The online method is reliable.  No idea why she thinks that an online process operated by the US government is not reliable.

2.  To petition a mother, you only need a copy of your birth certificate to show the required family relationship.  You can include a copy of her marriage certificate and divorce decree if you want.  Those documents are not required for the I-130, but will be required for the DS-260.

3.  Just the biographical page of your passport.  You do not need to include a copy of her passport for the I-130, it's only required for the DS-260.

Not only is online perfectly reliable, but you’ll get the petition in the system much faster. People have been reporting huge backlogs/delays with physical mailings - of around a month just to get a receipt notice and case number - whereas online gives you an almost instant receipt notice (usually same day). Plus, you cannot make errors with payment amounts etc as the system will give you exactly what you need to submit.
