Hello AOS forum,

My wife received her K-3 Visa Monday and we are now back home and ready to file her I-485 AOS. We read through the instructions and the example forms but it is not clear for K-3 visa holders which box to select. Any help would be greatly appreciated. My wife is 6 months pregnant and during her medical exam for the intervir=ew she did not have to have an x-ray. K-3 visas also did not require vaccines, has anyone else had a similar situation with pregnancy and if so will this delay the AOS process? I also have some questions about the EAD and AP. The EAD is needed to work but my wife may or may not work after the baby is born, do I have to file the forms for this now or can it be done at a later date? If add my wife to my bank accounts and she has interest income does this violate any USCIS laws by not obtaining EAD? My question for the AP is does she need this? In the I-485 directions it says that travel is ok for K-3 visa holders and AP is not required.

We are happy to be in this new forum and hope everything goes as quickly and smoothly as the K-3 process.

I don't know about the vaccination issue, but I expect that the pregnancy will be over before the adjustment application is ready to complete processing in the normal course of events and she will be told what she needs to do to complete the medical requirements.

She can apply for and EAD when and if she decides that she wants one, but recognize that having one can be useful for things other than getting a job - a SSN for one.

Interest income is not earned income (she didn't work for it).

The I-485 directions are correct with regard to K3 travel, AP not required - until the visa expires.

Another thing to consider, apply for the EAD before AOS, that way you would code the EAD to be based on the K-3's I-94 card, that makes the EAD a 2 year EAD, rather than the one year one based on the AOS filing, if you apply for EAD with or after filing AOS.
