Hey family..

I greet each and every one of you.

 

It's been over a month since i last did my interview at Lagos, Nigeria. Interview was on the 18th December, i got approved by the Consular Officer. He told me I have been approved and my Visa will be issued within 2 weeks time and kept my passport.     

 

It has been over a month since i had my interview, and my case status still showing as "Refused" case was only last updated on the 30th of December 2020. My wife is already worried and this delay is already causing issues, my marriage is already having issues as a result of as this delay.. 😥

 

I really do not know what else to do, I have called and written the U.S.A Embassy in Lagos, yet my Visa still not yet issued..

Please what else should i do, I'm so confused at this point... 😔😔😢

There is nothing you can do. My children was placed on Administrative processing since Feb 2020 and we've been waiting since then. 

It's very frustrating.

This whole thing is the first thing on my mind when I wake up and the last thing on my mind before going to bed. They asked for additional information which we submitted in December 2020 and the last time they opened the case was on the 30th of December 2020. 

Just keep hope alive.

It will all end in praise.

What is the status of the Nigerian immigrant ban?  

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The status? 

I don't really know what that means though, but I was sure given a Presidential Proclaimation on the day of much interview (A Waiver). Those that  day approved who got approved for Immigrant Visa gets a waiver during their interview..

 

My passport was kept my the Consular Officer, he said I'll receive my Visa in 2weeks time. And it's already past a month, whereas people been getting their passport back...

 

What should I do??

Other than emailing the consulate, there is nothing you can do.  It sounds like some form of administrative processing.

Yes that was what i was told when i called, they said "Refused & Administrative Processing" both the same thing, that I should wait..

Every case is different.  Some cases require additional checks, etc. after the interview  prior to being issued.

Additional check even after approval and all..??

Visas are not approved until after the interview and after any other administrative processing is complete.  This can takes hours, days, or longer.  Just watch for the status to change to issued.  That is the only way to know the visa was approved.  Hopefully, your status will change soon.

Wow! Yes the waiting is crazy. But I’m sure it will be issued very soon.

Hopefully i pray it gets issued soon, many out there also facing what I'm facing and it is really not funny at all.....

They did not keep my children's passport was returned to them and nothing since then.

Have you tried contacting them via email or calling them?? 

 

Because i have their phone number i have been calling all these while and also sending them mails...

 

Don't you think it would be better you do so? Or have you been hearing from them...???

How do the Proclamations address waivers?

 

An applicant who is subject to either P.P. 9645 or P.P. 9983 and otherwise eligible for a visa, but who does not qualify for an exception, will be refused but is automatically considered for a waiver by the consular officer during the visa interview.  Each applicant’s eligibility for a waiver is evaluated on a case-by-case basis; waivers may not be granted categorically.  A waiver may be available if:

  1. the foreign national has previously been admitted to the United States for a continuous period of work, study, or other long-term activity, is outside the United States on the applicable effective date under Section 7 of P.P. 9645 or Section 4 of P.P. 9983, seeks to reenter the United States to resume that activity, and the denial of reentry would impair that activity;
  2. the foreign national has previously established significant contacts with the United States but is outside the United States on the applicable effective date under Section 7 of P.P. 9645 or Section 4 of P.P. 9983 for work, study, or other lawful activity;
  3. the foreign national seeks to enter the United States for significant business or professional obligations and the denial of entry would impair those obligations;
  4. the foreign national seeks to enter the United States to visit or reside with a close family member (e.g., a spouse, child, or parent) who is a United States citizen, lawful permanent resident, or alien lawfully admitted on a valid nonimmigrant visa, and the denial of entry would cause the foreign national undue hardship;
  5. the foreign national is an infant, a young child or adoptee, an individual needing urgent medical care, or someone whose entry is otherwise justified by the special circumstances of the case;
  6. the foreign national has been employed by, or on behalf of, the United States Government (or is an eligible dependent of such an employee), and the foreign national can document that he or she has provided faithful and valuable service to the United States Government;
  7. the foreign national is traveling for purposes related to an international organization designated under the International Organizations Immunities Act (IOIA), 22 U.S.C. 288 et seq., traveling for purposes of conducting meetings or business with the United States Government, or traveling to conduct business on behalf of an international organization not designated under the IOIA;
  8. the foreign national is a Canadian permanent resident who applies for a visa at a location within Canada;
  9. the foreign national is traveling as a United States Government-sponsored exchange visitor; or
  10. the foreign national is traveling to the United States, at the request of a United States Government department or agency, for legitimate law enforcement, foreign policy, or national security purposes.
