Hi all. I am filling out form I-864 and i am not sure what to put in question 23 My current individual annual income is? Can anybody tell me exactly what they want to know here. I thank you all very much.

Mailed I-129F Packet 1/17/06 to TSC registered express mail. Was transfered to Cali.

Received 1/19/06.

Received Signed Return Receipt 1/22/06.

Check Cashed 1/27/06

Received NOA1 today 1/30/06 :-)

Received E-mail from USCIS Petition was approved on April 13, 2006

Received in the mail April 17,2006 NOA2

Received from NVC 5/4/06 Approval Notice. Petition was being forward to the Embassy in Manila :-)

Fiancee Received Packet 3 and Packet 4 together. She is to fill out Packet 3 and bring with her to the Visa Interview. Medical Exam scheduled for (8/30/06) and Interview Date (9/6/06) We are on our way.

Maybe I should given more detail. I am self employed so do i out down my salary before or after expences?

I can see that your timeline says you filed your AOS Jan 2007. You must have submitted your I-864 then. Is your question now relevant to an RFE for I-864?

If you are self employed, did you file a 1040 with the IRS with a schedule C? If so, use line 22 off of the 1040, which is your total income (or line 12 off of the 1040 if you are not supposed to include interest income, IRA distributions, dividend income, etc.)

If you didn't have to file a 1040, but instead filed a 1040-SS only, use line 27 of part IV, that is your profit from the business.

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

No "maybe" about it. If you want to get answers that apply to your situation you have to tell people what your situation is.

They want your income, not your business' income. Your business has deductable expenses, you do not.

Line 22 on your most recent 1040, unless you are doing better this year than last and you have some way of demonstrating that for year-to-date that you can extrapolate out for the rest of the year. Again - your income, not the business' income.

Was that 1099 all that he earned? If so, the same amount should show on the 1040. If not then then he short-changed himself, but maybe not by a significant amount.

Hmmm i thot my hubby's 1099 showed exactly what he earned for 2006. Now i see why i got an RFE for the AOS this morning if they go by the 1040 silly me

yep all he earned for last year shows on his 1099 and lets say it was over 25,000 :blink: which it was. He earned a few thousand more last year than he did for his 2005 taxes so i thought it would have been enough to support me for the I-864 but after receiving the RFE for initial evidence this morning i guess it wasnt. Theyre now looking for pay stubs for his current employment, he's self employed, we've just started our own business when we moved to Nebraska 2 months ago so he only has check stubs for the past 6 weeks. I've photocopied them all, ive even photcopied his contractors permits showing that this is just a new business and ive also asked my father-in-law to go co-sponsor for me as well. Do you think they will accept this or will they keep sending me RFE's???

OK so according to my taxes I made $32,000

BUT

I haven't worked this year because im in Brazil. I plan on getting a job in the states in September before my wifes interview in October.

So, under the question of Annual Income what do I put?

I would not make that assumption, we recieved the same request and I do ok salary wise. They just like more evidence.

Being that he changed to self employed, perhaps a co-sponsor may make it easier.
