Is your 3 year mark coming up?

My wife could have filed for citizenship in March 2020.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Is she choosing not to? I know a lot of people don’t wanna be citizens for their own private reasons!

To me I just wanna do legally whats ok and easier for me.. I don’t wanna keep doing this lol so i wouldn’t mind applying for the citizenship in the future

So I have been reading and I have a question.. My interview date is on February 8th, that is a month from my 2 year anniversary... will I still get the 2 year conditional green card or? It just doesn’t seem fair that I get that if technically we are already married for 2 years it’s just 3 weeks away from that point.. any experience in this?

Who knows, maybe they will take a month or so to decide upon approval.  I know in our case we would rather have approval quickly and have to file ROC, than to stress a month waiting.  Anyway, as others have said, ROC is more or less just a hassle, my wife filed the N400 when she could, and her ROC just became a formality.

Good Luck!

Is there another interview for ROC jeez? ahah

Oh so your wife filled for citizenship before her ROC got sorted out?

So you can’t fly outside usa until that sorted out right?

We need a document from her country which I forgot to get......but, at this point, she might just wait and file under the 5 year rule.  It's easier than the 3 year rule.

Depending on when the medical was taken,  determines when the visa expires (6 months from medical is the norm)

but if you can travel after the 2 year anniversary,  i would for the 10 year green card but watch that visa expiration date and don't mess up

OP is doing AOS

OP, it depends on when they actually approve your green card. For example, my interview was in February 2018 (see my timeline) but they had lost my medical, so they couldn't approve my green card immediately. The officer found the lost documents in the system in another office and requested for them to be transferred. We went home having no idea if they will send us a RFE for a new medical. A month later, it looks like they found my original medical and they just approved my green card. My resident since date is in March when they approved it, not in February. So you never know when the card will be approved.

Is it hard to remove the conditions? or just pretty much prove your marriage is still from love at that point too?

I heard some people applied for their Citizenship bc the 3 year mark came and the removal of the conditions still hasn’t happened

It's not hard if you have a regular case, it's just more red tape, money and waiting. But not the worst thing to happen in immigration.

so,  it is not when they do the AOS interview  but when the green card is produced (dated)?

With all you who go K1's go thru with AOS,  EAD,  AP and ROC,  i'm glad my 2009 K1 was denied and i had to go CR1

Removing conditions is more a hassle than difficult.

Yes, often times aliens become eligible for citizenship before conditions removed.   You simply apply for citizenship when you are eligible, if that is your wish.

The catch is, some people that have been interviewed in the US before, were going to be approved without an interview, but filing for citizenship sometimes makes USCIS combine both applications and then the ROC case is moved to an interview path. Depending on the local office, this might speed up the process or slow it down (people in Seattle have been waiting for 2 years for an interview). But I've seen cases of people that have filed for citizenship and didn't have the two cases combined and they got their ROC approved while waiting for citizenship to process.

Most people assume if you have an AOS interview, then you may not have an ROC interview.  Back when my wife was doing AOS, there were a lot of interview waivers, so more than likely those folks had an ROC interview assuming they were required to file it. My wife did have a sort of ROC interview, it was at the beginning of her N400 interview, and lasted less than 5 minutes.

The current policy is that those that haven't been interviewed in the US (such as those coming on a spousal visa) get a ROC interview no matter what and those that have already been interviewed by USCIS get an interview waiver. Then some people with unconvincing evidence and some unlucky folks get an interview as well. The policy used to be that very few cases get a ROC interview. Who knows what the policy is going to be like when your time comes.

It's when it's approved (when the "Welcome to the USA" letter is dated). The card is then produced a few days later, so the gap is minimal.

ok makes total sense! and i don’t mind doing the ROC to lift it but it’s just another $$ and time lol but i will do what they ask from me and thats all we can do!

I just hope i don’t have to attend another interview 😂

I mean you could ask to reschedule your interview hoping it will be after your anniversary but it could be just one day before again. Or in months. Or something get lost and suddenly you're a no show for your original interview. Would be too risky for me but it's an option 😁
