Does anybody know if filing for an ITIN# (Form W7) for my spouse will effect filing for AOS for a Green Card? We are just getting ready to also file the AOS. It says on the W7 "don't submit this form if you have, or are eligible to get a US social security number".

 

We are not eligible to get a SSN until we actually have a Green card so I am hesitant to file for the ITIN# to file for 2020 taxes.

Why are you hesitant?  You are not yet eligible for SSN.  ITIN is your only other option.

K-1s whose authorized stay has not expired are eligible to get an SSN.  Many K-1s in VJ got SSNs before AOS or EAD.  This includes my then fiancée.  This has been discussed extensively  on VJ.

She can request a SSN with her I-765, can't she?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Original question was will having an ITIN have any effect on AOS.   The answer is NO.  The USCIS doesn't care if you have an ITIN or not.

True.  I was referring to his statement about having to wait for the Green Card.

Nope,  it doesnt

just remember to change the ITIN to your new SS# when you get it 

like with IRS,  the bank and any credit card as you can have a credit report with ITIN if name is on a card

First thing you get as a K1 is a SSN, wait a few days after arrival to make sure it is in the system.

Legit as in, yes, they will get all your info, fill out the form for you and send it to the IRS while charging you a bunch of money for something you can do yourself? 

 

Sure, it seams as legit as RapidVisa.... doesn't mean someone should use them.

 

It took me all of about 3 minutes when I filled out the ITIN application for my wife.

Basically you have to apply for ITIN as you are married and need to report IRS tax returns as MFJ or MFS

filing separate would mean she is going to file for herself and if she doesn't have green card or SS #,  how can she?

So,  you will be filing MFJ and filing out the W 7 for ITIN

MFS does  indicate the possibility of seperate filings, but often times, the alien does not have any income to tax therefore no return
